The above trao requests were considered together. <br />Presentm Mr. Waterbury, Mr. Andreano and Attorney Moss and Mr. and Mrs. Hy- <br />duk who were administered the oatho Cases and appeals were read:. <br />Nlr. Moss read his prepared statement and explained variances re- <br />quested; Mr. Page, principal of Pine School suggested a walkway <br />through to the'school, inasmuch as Sub Zots 4, 5 and 6 are within <br />1t0 ft. of the school. He also said the rear of the lots is gath- <br />ering place for youngsters. Modified requests were submitted for <br />. Sub Lot #3 and Sub Lot #7• <br />Law Director Gareau read Section 1133013 Powers In Regard To An <br />Appeal Par. (A) (B) and (C). Chairman Ledvina called for a vote <br />on each (A) (practical difficulty or unnecessary hardship) - all <br />aye; (B) (deprivation of property rights) - Messrs. Hamill, Rem- <br />mel and Ledvina, aye; Mr. Huntington, nays (C) (strict applica- <br />tion of Zoning Code) - Messrs. Hamill, Remmel and Ledvina, aye; <br />Mr. Huntington, nay. Request were granted with 15 ft. front yard <br />variance and 5 ft. rear yard variance on Sub Lot #3 and Sub Lot #7; <br />and with recommendation to ,Planning Commission that fence be built <br />behind vub Lot #30 <br />8. S& W. Development Co., 4430 Silverdale Rd. Request for variance (1133.13). <br />Request for non-conforming lot. Request for 711 sq. ft. variance for vacant <br />lot, one lot North of 4221 Dover Center Rd. Violation of Ord. 62-33 Section <br />1157.01. <br />9. S. & W. Development Co., U30 Silverdale R.d. After study of plans and some discussion IVIr. Remmel mov- <br />ed to grant variances as requested. Mr. Hamill seconded and mo- <br />tion passedo <br />At this time a representative of Caldwell Della Vella Building Co. appeared be- <br />fore the Board and requested aSpecial Hearing. Hearing to be held March 16 - <br />7:30 p.m.
