Planning Commission 11-11-75 <br />-3- <br />Elaine Vasniak, 27482 Edgepark Dr., said she had no idea there ever was <br />to have been a road. She lives across the street. <br />L. McCarthy, 27533 Marquette asked what will formulate opinion for P1an- <br />ning Commission members exactly. Bob Grace of Blossom Blvd. asked if this <br />is North 0lmsted Planning Commission why is this body considering the plan <br />when only one lot is actually in North Olmsted and the remainder in lqest- <br />lake. <br />Commissioner Tischler mentioned the possibility of non-conformance of the <br />two existing homes in either side of proposed roadway, asked again if any- <br />one can tell him. <br />Bi11 Hyde, 27480 Blossom Elvd. said his house with attached garage is 72 <br />ft. from propexty line on either side. He lives on Sublot#204, adjoining <br />Sublot #205, <br />Commissioner Freeh asked why Planning Commission is considering this pro- <br />posal again if Planning Commission approved same in 1969. <br />Law Director Gareau said he had never run into this problem before, per- <br />haps reasonable time has elapsed since original proposal. He offered to <br />research and issue a legal opinion. <br />Commissioner Tischler moved to retain in committee until law Director <br />Gareau renders his opinion. Opinion is to help clarify whether or not <br />matter is proper].,y before Planning Commission and if there is a time limit. <br />Mr. Freeh seconded the motion. <br />Residents expressed dismay that matter could not be settled at this meeting <br />and asked why legal aspe cts were not brought up between previous meeting and <br />this one. <br />Commissioner Tischler asked Law Direetor Gareau that the legal implications <br />of homes being 72 ft. from lot lines adjacent to Sublot #205 be included in <br />his opinion if it is found this item legally is before this body. <br />IvIrs. Baratko, 27337 Edgepark Dr. spoke of objections and said not to make <br />a mistake like Lorain Road and ].et this road go through. <br />Secretary Eian called the roll on this motion and it passed unanimously. <br />Proposal is to remain in committee. <br />V. New Deve].opments and 5ubdivisions <br />(a) Romp Bros. Development, Inc. - Rezoning East side of Eolumbia Rd. <br />South of Zorain Rd. - 2 lots <br />Mr. McDermott distributed location maps. Councilmen Goggin, Sharpe <br />and Beatty assembled before the Commission. W. Geisser, an attor- <br />ney representing Romp Bros., gave presentation. Planned is 18 hole <br />miniature golf course with all ground lighting, solid fence on resi- <br />dential side. He stated there is variance for parking on land to be <br />rezoned. There was discussion as to whether the whole lot has vari- <br />ance or only a portion of the lot has been granted variance for park- <br />ing. Councilman Sharpe, representing the residents of Columbia Road
