Planning Commission 11-11-75 - L - <br />said they are all against the rezoning. Reasons for objection were <br />given by Mrs. Sharpe as noise, traffic, lights and congestion. <br />Commissioner Tischler asked what is wrong with the map. Explanation <br />of drawings was given - a house exists on the second 1ot but some <br />parking is allowed by variance: The existing house would be de- <br />molished for miniature golf course. Request is for rezoning of entire <br />length of the two resid'ential lots. Commissioner Freeh said it would <br />be placing commercial directly acros's the street from residential and <br />beside residential. <br />Mr. Traffis, who owns and resides at L389 Columbia Rd. and owns the <br />property at 4377 Columbia Rd., which is immediately south of the pro- <br />perty in question, objects because of the noise involved. He would <br />like to see the area retained as residential. <br />Law Director Gareau said when one seeks rezoning of a parcel, he does <br />not need to indicate purpose for which it is to be used. The property <br />owner is not bound to develop according to plans as presented. There <br />have been such pitfalls before in the City.. He further stated zoning <br />lines have been established. There is argument that lines can be put <br />back time and time again, but then there must be a limit. The new <br />Comprehensive Plan Map shows this area as residential. <br />Attorney Geisser said Law Director is correct and that Rom pBros, are <br />willing to place a deed restriction with the city. He spoke of the two <br />parcels of land, that the :ma'l front parcel is residential and asked <br />why the line is where it is. Plan is to clear this up and have square <br />line zoning. <br />Mr.,Freeh moved to refuse to recommend this proposal to Council for <br />rezoning. Mr. Roberts seconded and motion passed unanimously. <br />At this time Mr. Jack Richards of Holly Dr. spoke. He said this can- <br />not be Futt Putt Golf. He has the franchise. He is negotiating to <br />build Putt Putt in conjunction with the Great Northern Shopping Center. <br />(b) Helen S. Brown Subdivision - south side of Lorain Rd, west of Great <br />Northern Blvd. - combining of 2 lots. <br />Engineer PIcDermott distributed location maps. Location is across <br />from Root Road west of Great Northern Blvd. Iand is vacant at pre- <br />sent. Mr. McDermott said proposed lots meet requirements of frontage <br />and area. Mr. Marshall Bro-on, representing his mother, Helen S. Brown, <br />was present and said there are no plans for development. <br />Mr. Tischler moved to approve Helen S. Brown Subdivision. Mr. Freeh <br />seconded and motion passed unanimously. <br />VI. Communications <br />(a) Planning Commission members had received copies of Ord. 75-224 and <br />cover letter from Nora T. Hill, Clerk of Council. The ord-nft-o&oD6A- <br />cerns small piece of property behind Len Derin Dodge, Inc. 26100 <br />Lorain Rd. and is a mandatory referral. Mr. Roberts moved to ap- <br />prove Ord. 75-224. Mr. Tischler seconded and motion passed unanimously.
