BOARD OF ZONING APPEALS -(10/6/71) - Page 3 <br />10. Appellant: N1r. Nick J. Kugler, 5905 Decker Rd. - Request for a41 rear <br />yard variance (1133,13) and garage side line variances of 31 on the east <br />side and 2' on the south side. Request is in violation of Ord. #62-33, <br />Section 1163,01, which requires a 50' rear yard and also #1151.04, detached <br />garage requires a 5' rear and 5' side line. <br />Present: Mr, Nick Kugler. <br />?y . <br />Mro Kugler was sworn in. Mr. Kugler presented his plans. He said he woul.d like to take <br />11 feet off of the 1ot he is presently living on and add this 11 feet to the lot on the <br />right side, therefore ending up with a 69' and 51° 1ot, He said that the two adjacent <br />lots wi.11 enhance each other. Mr. Tubbs made a motion to grant the variance, but Mr. <br />Kugler wi11 have to get permission from the Planning Commission to reduce the 80, lot <br />to 691. Mr. Berglund seconded the motion and it was unanimously passed. <br />11. Appellant: Mr. Robert E. Cheeley, 3400 Dawn Dr. - Request for an 8' rear yard <br />variance (1133.13). Request is in violation of Orde #62-33, Section 1151,04, <br />which requires a minimum of 20' between dwelling and any detached garagee <br />Present: Mr. Robert Cheeley, Mrs. Robert Cheeley, Mr, Norbert Mazanec. <br />A11 witnesses were sworn ine Mr. Cheeley said that he has a tri-1eve1 home and there is <br />nc basement for storage. Mr. Norbert Mazanec, 25377 Fai,m Drive, stated that the garage <br />is rather large for the situation in this area. He was concerned about his property <br />being saleable with the garage so close to his propertym Mr. Scheef suggested they put <br />up a 22' garage and move it over 3 feet. Mr. & Mrs. Leslie Warren,, next door neighbors, <br />said they had no objection to the garage being moved closer to their property, Mr. Scheef <br />made a motion that the garage be3.ng constructed be 22' x 221 and that it be located 20' <br />from the house and 3' from the side property line, granting a variance of 2' on the side <br />property 1ine. A1so granting a variance from the adjacent structure of 3'. Mr. Tubbs <br />seconded the motion and it was unanimously passedo <br />12, Appellant: Mr. Leslie Warren, 3410 Dawn Dr. - Request for a 102 ft. side yard <br />variance (1133.13) and 6 ft. rear yard variance to nearest dwelling. Request <br />is in violation of Ord, #62-33, Section 1151.04, which requires detached garage <br />should be 20' from dwelling on same 1ot or any adjacent 1ot. <br />Present: Mr. & Mrs. Leslie Warren, Mrs. Edward J. 01ech, Mro B. A. Scott. <br />A11 witnesses were sworn inm Mr. Warren presented planse Mrs. 01ech stated there would <br />be no problem as far as her property was concerned. Mr. Scott' 3416 Dawn Dr., stated <br />that his home is unusually placed as there is not even 3 feet from the back.property <br />line. Mr. Scott was opposed to Mre Warren's garage being so close to his house. He <br />felt that it would depreciate the value of his home, Mr. Tubbs stated that a 24' garage <br />is rather large. Mr. Scheef suggested a 221 garageo Mr. 5cheef also stated that a burden <br />was placed on this lot by moving the garage next door 21 closer. Mr. Scheef made a motion <br />that the garage size be redueed to 22' x 22' and that it be located 5' from the south <br />property line and 5' from the west property line, thereby granting a variance of <br />approximately 112' on the south side to the adjacent structure and 6' to the structure <br />on the vae5t side of the garage, and that both the south and west walls of the proposed <br />structure be fire walls. It was seconded by Mr. Tubbs. The motion passed with Mr. <br />Roberts voting noe '
