Board of Zoning Appeals 6-6-73 <br />_ 2 _ <br />2. Otto Halvacs, 1352 Bonnieview Ave., Lakewood9 0, 44107. Request for vari- <br />ance 1133.13 for permanent parcel 232-5-1 on North Par k Dr. of 13 ft. <br />rear yard setback. Violation of ard. 62-33 Section 1163.01 requiring 50 <br />fte rear yard. <br />Present: Mr. Halvacs and Mr. and Mrs. Malchus? Witnesses were administer- <br />ed the oath. P7r. Scheeff read the case. Mro Gundy said the City of North <br />Olmsted is appropriating 50 ft. to widen Brookpark Road. This will affect <br />size of Mr. Halvacs' lot. 13 ft.variance is requirede Mrso Eian moved to <br />grant 13 ft. rear yard variance, seconded by Mr. Duskey and passed. <br />3. Robert D. Pott, 2L998 Doe Ur. Request for variance (1133.13) of 3 ft. at <br />side yard for garage, leaving 2 ft. Violation of Ord. 62-33 Section 1161. <br />01. "The minimum width of the side yard shall be, on one side, not less <br />than 5 ft. and the sum of the two sides shall be not less than 20 ft." <br />Present: R. Pott and F. Nowakv Witnesses were administered 'Uhe oath. <br />Mr. Scheeff rea.d request and description of property. Garage is to be <br />built as detached, owner wishes to keep good tr2e in yarda Houses are <br />laid out wrong ori Doe Drive. N1re Roberts moved to grant 3 ft* variance, <br />seconded by Mr. Hamill and passed. <br />!t. Richard Tabar, 23044 MacBeth Ave. Reque st for variance (1133.13)o Re- <br />quest for 2 ft. variance f or fencee Violation of Ord. 62-33 cection 1151. <br />04 limiting height of fence to 4 ft. <br />Presenta Mr. and Yrsm Tabar, Mr. and AIrs. Teschner, Mr. and Mrs. Roth. <br />Tnritnesses were administered oath. Existing fence does not obstruct view. <br />Many facts and pictures and review of court case were preserrted. Basically <br />neighborhood dog is probleme Mr. Roberts moved variance of 2 ft. for fence <br />be granted. Mr. Eian seconded an d motion passed. <br />5. Myron A. Klimkowicz, 24276 Mastick Rd., Request for variarbce (1133.13) <br />Request for special permit to erect tool shed. Violation of Ord. 62-33 <br />Section 1133.09. ' <br />Present: Mr. Klimkowicz. Witness was administered the oath. Mr. Scheeff <br />read the case. Lot has hedges and hemlocks. Shed is to be located 50 ft. <br />from dwelling and 5 ft. from property line. There are no complaints from <br />neighbors. Mr. Duskey moved to grant request for special permit. N1rs. <br />Eian seconded and rmtion passed. <br />6. Thomas Ridgley, 3363 W. 231st St. Request for variance (1133.13). Request <br />to add to non-conforming dwelling (present setback is 41 ft.) in violatio n <br />of Ord. 62-33 Section 1231.02. <br />Presents T. Ridgley and T. Cleary. Witnesses were administered the oath. <br />Mr. Scheeff read the request. Planned is 24 ft. x 12 ft. addition. There <br />is 4 ft. setback at one pointo Addition will conform. Mr. Roberts moved <br />to grant special permit for addition to nori-conforming dwelling, Mr. <br />Hamill seconded and motion passed. <br />7. Ronald Is gar 6316 Stafford Dr. Request fo r variance (1133.13) Request <br />for f6 to rear yard variance to enable him to build addition to dwelling. <br />Violation of Ord. 62-33 Section 1163.01 requiring 50 ft. rear set back.
