Board of Zoning Appeals <br />_ 2 _ <br />4. George J. Abraham, 4147 Dryden Dr. Request for variance (1133.13)• Re- <br />quest for 7 ft, side yard variance. Violation of Ordo 62-33 Section 1161. <br />01. Also request for 2 ft. variance for fence. Violation of Ord. 62-33 <br />Section 1151.04. <br />?, <br />Present: Mr. Abraham, kTm. Grady and his son. Case and appeal were read <br />Witnesses were administered the oath. Mr. Abraham explained drawing, size <br />of lots, proposed patio (20 ft. x 20 ft.) and 6 ft. slat fence for screening. <br />Hardship involved is lack of privacy. Mr. Grady, 25988 Byron Dr. expressed <br />opinion proposed fence is too high; his windows face the fenced area. Mr. <br />Duskey moved to continue. Mr. Roberts seconded and motion passed. Casa <br />continued until Sept. !t, 1974. <br />5. Request of Wm. Lichtig, 24930 Mitchell Dr. Request for variance (1133.13)• <br />Request for 1 ft. fence variance. Violation of Ord. 62-33 Section 1151.04. <br />Present: Mr. Lichtig, two neighbors and Mr. Sweeney, attorney representing <br />Mr. Lichtig. Case and appeal were read. Witnesses were administer- <br />ed the oath. Previous owner had erected fence without permit. Home <br />was purchased in 1971 with fence which is 12 ft. from sidewalk. <br />Mr. Kuivinen, a neighbor, also has fence and ha.s no objection. A <br />letter from Mrs. Campana, another neighbor, reflects no objection <br />to height. Mr. Ledvina moved to approve. Mr. Duskey seconded and <br />motion passed. <br />6. Friendly Ice Cream Shop. Request for variance (1133.13). Request for front <br />setback variance at 24950 Lorain Rd. qiolation of Ord. 62-33 Section 1174.02. <br />Present: Boyd S. Richardson, Jr.-Mrs. Zipp, Mr. Janik and MaV?:?d Mrs. Herman. <br />Case and appeal were read. Witnesses were administ'ered the oath. <br />Mr. Richardson explained Tocation (between beverage store and barber <br />shop) and described operation of the business. Pictures were display- <br />ed. Plea is for relief from hardship of obscurity. Desire is to be <br />visib3e from approaching traffic. The Brennan building, which houses <br />the beverage store, is non conforming inasmuch as it is too close to <br />Lorain"Rd. It was constructed before present zoning. 8z ft. front <br />setback variance is requested. Mr. Janik said he is apposedsta->the <br />granting of such a request. NIr. Janik's barbershop conforms with <br />50 ft. setback ordinance. Mr.•Ledvina moved to reject, seconded <br />by Nfr. Duskey and passed. Request denied. <br />79 RTorth Olmsted Assembly of God, 3874 Columbia Rd. Request for variance (1133.12) <br />Request for special permission to build new sanctuary in residential area.xpec- <br />ial permission required by Ord. 62-33 Section 1151.01 (E). <br />Present: Rev. Panfield, Don Drake, N. Fox. TrJitnesses were administered the <br />oath. Case was read and plans displayed. Mr. Drake gave explana- <br />tion of progress since basic plan was approved in 1970. Mr. Fox <br />cited traffic problem. He said driveway is too close to home of <br />one neighbor and he questioned distance from sidewalk for parking <br />and landscaping. After examination of plans by Board members, Mr. <br />Duskey moved to grant special permit to build new sanctuary 60 ft. <br />x 120 ft, with the following provisions: IIpon completion residential <br />building on southeast corner of parcel be raZed; addition of new <br />drive on northern portion of property; and no parking within 50 <br />feet of Columbia Rd, area to be landscapedy per attached plan. <br />Mr. Ledvina seconded and motion passed.
