1. A 13 foot variance for fi•ont yard setback, code requires setback of 20 ft to parking and <br />drives, applicant shows 7 ft, section 1139.07. <br />2. A 2 foot variance for fi•ont building setback, code requires setback of 75 ft to the building, <br />applicant shows 73 ft, section 1139.07. <br />3. A variance for a canopy sign extending above the canopy, code does not permit, applicant <br />shows sign located above the canopy, section 1163.29(b). <br />4. A variance for ground signs too close together, code requires 200 feet of separation, applicant <br />shows less, section 1163.27(a). Note: existing menu board will be relocated closer to the <br />existing pole sign. <br />5. A variance for enlarging a non-conforming building; code requires any addition conform to <br />all setbacks, applicant shows violation of front building setbaclc, section 1165.02(b)(1). <br />Randall Showalter of Burger King and Michael Dauss of Dauss Architects were administered the <br />oath. Mr. Showalter said Burger King is completing a world wide imaging updated. The site is <br />a non-conforining site which is being updated to address appearance, circulation and green <br />space. Mr. Dauss said out of over 75,000 stores in the US this site is #368 which puts into <br />perspective the age of the site. The site does not nor can not meet today's zoning code <br />requirements. The 13 foot fi•ont yard parking setbaclc is due to addressing onsite traffic <br />circulation which will be one-way. In order to be ADA compliant they are required to increase <br />the entrance which puts them 2 feet into the required building setback. The variance for the <br />canopy is due to the sign being atop the canopy. The existing menu board will be relocated from <br />the north elevation to along the east side of the building. As the lot is only 217 feet deep there is <br />no way to place the two ground signs to code. In the upgrade they are providing a privacy fence <br />and additional green space along the northern property line to further buffer the neighboring <br />resident. There will be no parlcing along the northern elevation and traffic will be a one-way <br />circulation pattern. <br />Mr. McReynolds said placing the menu sign along the eastern elevation will benefit the neighbor <br />to the north by reducing noise. Ms. Wenger said green space along the north, east and west <br />elevations have been increased which is an improvement to the existing condition. To make up <br />for the northern parking spaces which are being eliminated additional parlcing along the south <br />elevation was added. The projected changes on the site will enhance the aesthetics of the <br />neighborhood and fit into surrounding upgrades taking place. Mr. Lopez asked how they would <br />address the sign atop the canopy. Ms. Wenger said that in this application the projected sign fits <br />the building. However she would not want to amend city codes to allow such signs as a rule. <br />Ms. Diver asked if the existing pole sign would be addressed. Mr. Showalter said the pole will <br />be painted blaclc. Mr. Dauss said the menu board will be along the east elevation and placed in <br />between the emergency egress door and northern corner of the building. Ms. Diver said the <br />improvements are a welcome change for the site and neighboring residents. Mr. Lopez said the <br />improvements and impact they will have upon the corner justifies the variances needed although <br />he would lilce to see the non-conforming pole sign removed. <br />Mr. Lopez moved, seconded by Mr. Raig, to grant CMS12-17: Burger King of 26270 Lorain <br />Road a special permit to add to a non-conforming building section 1165.02 and the <br />following variances: <br />5
