Mr. Kluchin reviewed the site plan. The existing pool will be replaced with new parking and <br />landscaping. The rear and side yard setback is 100 feet each which significantly restricts the use of <br />the property. The new building would be setback 50 feet from the rear lot line and 46 feet from the <br />side yard line. There will be a 6 foot metal aluminum fence around the pool and an 8 foot board on <br />board fence will include a gate to ensure access to the ditch. Landscaping will be added to the site <br />to provide abutting residents as much buffering as possible. Some of the existing trees in the area <br />are in poor condition and will be removed. The building will be constructed using split face block <br />colored to match the existing buildings and blue roof shingles to match the new awnings. The new <br />owners are cleaning the grounds and working to enhance the site. Building anything along the rear <br />of the site would require variances due to the restrictive setbacks. <br />Mr. Malone said the Norway spruce trees are aggressive growers and provide good buffering. Ms. <br />Nader asked if the dumpster enclosure would be gated as the dumpster was in poor condition. Mr. <br />Kluchin said they would prefer not gating the dumpster enclosure as they become a maintenance <br />issue. Members reviewed the standards and felt a conditional use permit was warranted. <br />Mr. Malone moved, seconded by Ms. Nader, to grant a conditional use permit for <br />recreational facilities in a residential district to CMS 13-42: Kensington Court Apartments <br />of 23307 Lorain Road which passed 4-0. <br />Board members felt the required 100 foot rear and side yard setbacks were excessive and granting <br />the variances would assist the owners to enhance the site. Granting the height variance for the fence <br />would provide additional buffering to the abutting residents therefore the 2 foot height variance is <br />also warranted. <br />Mr. Malone moved, seconded by Ms. Nader, to recommend BZA grant CMS 13-42: <br />Kensington Court Apartments of 23307 Lorain Road the required setback variances needed <br />which passed 4-0.
