Mr. Russell said he had no objections to the request but <br />noted final placement of the fence would be subject to engineering approval. A 30" variance for <br />height of fence is required if the height is to be 5' high. Mr. O'Malley reviewed zoning code <br />requirements for fences and the difficulty corner lots have placing fences to code. Ms. Bellido <br />said zoning codes are more restrictive on corner lots. The style of fencing chosen is elegant, 50% <br />open and will not adversely impact the neighbor. Mr. Allain commended the applicant for being <br />considerate of their neighbors when researching and choosing the fence for their yard. <br />Mr. Papotto moved, seconded by Mr. Allain, to grant APP15-3653: Sandy Dang of 27729 <br />Marquette Blvd: The following variances as amended and agreed upon: <br />1. A 50' variance for a fence in the rear yard of a corner lot that is not located at the <br />required front building setback of the abutting lot on the side street; code requires 501, <br />applicant shows 0', Section 1135.02 (f)( 2),1135.06 (a). <br />2. A 30 inch variance for height of fence section 1135.02 (f) (1). <br />3. The placement of the fence is conditioned upon engineering approval. <br />Motion passed 4-0. <br />APP15-3311: Sharon Calvin: 5072 Andrus Ave: <br />Proposal consists of a detached garage. The following variances are requested: <br />1. A 7' variance for a detached garage less than 10' from a rear property line; code requires 10', <br />applicant shows 3', Section 1135.02 (c) (2). <br />2. A 130 sq. ft. variance for total area of accessory structures exceeding 20% of rear yard; code <br />permits 550 sq. ft. (20% of 2,750 rear yard), applicant shows a rear yard of 2,750 sq. ft. (50' x <br />55') with deck 196 sq. ft. and garage 484 sq. ft. for a total of 680 sq. ft., Section 1135.02 (d) <br />(3)• <br />The oath was administered to Debra Casto applicant's daughter, and contractor John D'Amico. <br />Mr. D'Amico said the small lot abuts commercial property. The new garage will be 22'x22' and <br />placed in the same location as the existing gaxage, which is 3' off the rear property line and 5' off <br />the side lot line. The garage can't be any closer to the home or its access will be compromised. <br />Ms. Bellido asked if the pool and plastic shed would remain in the yard and Ms. Casto said there <br />is no pool in the yard and the plastic shed will be removed once the garage is finished. Mr. Raig <br />said regardless the size of any lot our zoning code requires a garage therefore he has no <br />objections to the request. <br />Ms. Bellido moved, seconded by Mr. Allan, to grant APP15-3311: Sharon Calvin of 5072 <br />Andrus Ave, the following variances: <br />1.
