15-3783: Brioida DiRuggiero; 5375 Decker Road <br />Proposal consists of a front deck. The following is requested: <br />1. A special permit is required to add to a non-conforming building (1165.02). <br />2. An 8 foot variance for a deck in the front yard setback; code requires 50 ft., applicant shows <br />42 ft., section 1135.06 (a). <br />Note: It appears the home/structure was built across two parcels. <br />The oath was administered to Brioida DiRuggiero, Ernesto DiRuggiero and neighbor Pat <br />Henson. Ms. DiRuggiero said they would like to install an 8'x 19' deck in the front of the house <br />so her son can sit outside and enjoy the yard. Ms. Henson asked if the deck would be just along <br />the front of the home or would it include the side of the home. Ms. Rudolph said the plan showed <br />the deck only in the front of the home. She asked if the sidewalk and awnings over the windows <br />would be removed for the deck. Ms. DiRuggiero said the sidewalk would be removed but the <br />awning would remain. Mr. Allain asked why a special permit was needed. Mr. Russell said it <br />was found that the home straddles two lots which appear to be the case with a few homes within <br />the neighborhood. Ms. Rudolph asked if the board should require the owner to consolidate their <br />lots. Mr. Gareau said the home on two lots has been in existence since the home was constructed; <br />to require the owner to consolidate the parcels now is not necessary. Members questioned the <br />difference between a deck and patio. Mr. Russell said the request could be worded as an open <br />porch or deck. The variance is required because the deck/patio exceeds the required front yard <br />setback. Mr. Raig said he objected to a deck in the front yard. <br />Mr. Papotto moved, seconded by Ms. Rudolph, to grant 15-3783: Brioida DiRuggiero of <br />5375 Decker Road the following: <br />1. A special permit to add to a non-conforming building, Section 1165.02. <br />2. An 8 foot variance for a patio in the front yard setback; code requires 50 ft., applicant <br />shows 42 ft., Section 1135.06 (a). <br />Motion passed 4-1, Mr. Raig voted no. <br />15-3786: Stephen Hudak; 5150 Dewey Road <br />Proposal consists of a rear deck. The following variances are requested: <br />1. A special permit is required to add to a non-conforming building (1165.02), existing home <br />exceeds lot coverage. <br />2. A 16 ft. variance for rear yard setback, code requires 50 ft., applicant shows 34 ft., Section <br />1135.08 (a). <br />3. A 100 square foot variance for maximum lot coverage; code requires 2656 sq. ft., applicant <br />shows 2756 sq. ft., Section 1135.05 (c). <br />Note 1. It appears the home/structure was constructed across two parcels. <br />Note 2. On 7/9/03, BZA granted a variance of 225 sq. ft. for total square footage of lot being <br />under 10,850 sq. ft. and a 20 ft. front yard setback variance, for home having a 30 ft. setback. <br />The oath was administered to Stephen and Kimberly Hudak and contractor Joe Trounzo. Mr. <br />Hudak said they would like to have a deck along the back of their home. The dimensions have <br />changed since the contractor applied. They are now asking to have a 12'x16' deck. Ms. Hudak <br />said there are only three steps out the back door to the yard. They would like to add the deck so <br />they can sit out and enjoy their backyard. Mr. Raig said the special permit is for the home
