A 100 sq. ft. variance for a shed in the rear yard; code permits 80 sq. ft., applicant <br />shows 180 sq. ft., Section 1135.02(d). <br />2. A 7-1/2 in. variance for the shed height; code permits 8 ft., applicant shows 8 ft. 7-1/2 <br />in., Section 1135.02(d). <br />1Zo11 call: Papotto, Raig - yes; Allain, Meredith, Sabo - no.lVlotion denied 2-3. <br />COMMERCIAL APPEALS AND REQUESTS <br />15-4683; Dollar General; 3785 Clague Road <br />Proposal consists of a new commercial building and site improvements, the following variance is <br />requested: <br />1. A 10 ft. variance for side yard setback (north property line) for parking and drives; code <br />requires 10 ft., applicant shows 0 ft., Section 1139.07. <br />The oath was administered to Jeff Paulson, Civil Engineer. Dollar General revised plans to <br />accommodate issues for 3 of the initial variances. He explained the variance request. The <br />existing CVS canopy is 12 feet from the property line and removing the pavement would not <br />leave them enough space to drive though, as well as not leaving enough space for the existing <br />private access easement. The proposed plan requests to saw cut the southern 3 feet of the existing <br />easement which is in disrepair. All of the improvements, landscaping, parking lot and dumpster <br />enclosure would be ten feet from the north property line. Ms. Wenger stated the presence of <br />private easements does not excuse them from complying with the zoning code. However, the <br />unique circumstance of the curb cut being split by a parcel line after it was installed requires a <br />variance. Mr. O'Malley stated that the property came with the easements when it was purchased. <br />Mr. Allain called into question the culvert on the east property line, Mr. Paulson stated they are <br />trying to work with CVS to formalize a maintenance plan for the culvert, but nothing is finalized <br />yet. Mr. Raig complimented Mr. Paulson on being able to comply with the ordinances given the <br />shape of the lot and the conditions they had to work with. <br />Mr. Papotto moved, seconded by Mr. Allain, to grant 15-4683; Dollar General; 3785 <br />Clague Road the following variance for a nevv commercial building as written: <br />l. A 10 ft. variance for side yard setback (north property line) for parking and drives; <br />code requires 10 ft., applicant shows 0 ft., Section 1139.07. <br />Motion passed 5-0. <br />15-4723; Starbucks; 27190 Lorain Road <br />Proposal consists of demolishing existing structures, constructing a new commercial building <br />and site improvements, the following variances are requested: <br />1. A 20 space variance for required parking spaces; code requires 44, applicant shows 24, <br />Section 1161.05(c). <br />2. A 59 ft. variance for building side yard at Dover Center Rd.; code requires 75 ft., applicant <br />shows 16 ft., Section 1139.08(a). <br />4
