Mr. Papotto moved, seconded by Mr. Allain, to grant the following variance as written for <br />16-7076; Mohammed Musleh; 4603 Porter Road, <br />1. A variance for a driveway in an insufficient side yard; code requires a side yard of no <br />less than 15 feet where a driveway is proposed, side yard is less than 15 feet, Section <br />1135.07(a). <br />Motion passed 5-0. <br />16-7094; Sean McKay; 25112 Gessner Road <br />Representative: Lee McKay, brother of owner, 3737 Walter Road, North Olmsted, OH <br />Proposal consists of a private garage. The property is zoned One Family Residence C. <br />The following variances are requested: <br />1. A 2-1/2 in. variance for side yard setback; code requires 5 ft., application shows 4 ft. 9-1/2 <br />in., Section 1135.02(c)(2). <br />2. An 8 in. variance for the height of the garage; code permits 15 ft., applicant shows 15 ft. 8 <br />in., Section 1135.02(c)(1). <br />3. An 82 sq. ft. variance for a garage over 750 sq. ft.; code permits 750 sq. ft., applicant shows <br />832 sq. ft., Section 1135.02(c)(1). <br />Mr. Aspery stated that the applicant is requesting variances pertaining to the construction of a <br />new detached garage to the northeast of the existing house. Variances are requested regarding <br />side yard setback, the height of the structure, and the area of the structure. <br />Mr. McKay stated that the current garage is in poor condition and the owner would like to install <br />a larger garage with a higher ceiling to accommodate his large truck and hide them from view of <br />the neighbors. He is willing to move the garage to remove the first variance required. Ms. <br />Meredith clarified that the proposed garage would use a new foundation. The extra height is <br />needed to clear the headers of the truck which has larger tires and suspension installed. Mr. <br />McKay stated that the owner owned the truck prior to purchasing the home. The primary reason <br />for the request for the additional square footage is to accommodate the longer truck length. A <br />10-foot overhead door would be installed. Currently the truck is for recreational purposes, but in <br />the future, the owner would like to install ladders for his side job. Mr. Papotto asked if the trailer <br />is used for work and would be stored inside. The owner works in the construction industry and <br />the truck is not owned by a company. <br />Ms. Meredith pointed out that the lot behind the property would not be affected by a larger <br />garage. It would be good for storage and safety of the owner's property. Mr. Papotto stated that <br />the length requested is not unreasonable due to the length of a Ford F-250 truck and to <br />accommodate a tool bench. Mr. Papotto suggested splitting the variances and he did not have an <br />issue with the height variance. Mr. Allain was concerned that the variance would allow for future <br />business use of the property if it is granted. He also added that the vehicle was purchased prior to <br />the property, therefore the owner created the hardship for himsel£ 1VIs. Sabo added that the <br />vehicle was modified to increase the height which requires a bigger garage, even though the <br />modifications are not necessary to use the vehicle, Mr. Allain agreed. Mr. Raig pointed out that <br />the proposed garage would only be three feet longer than the current gaxage. Ms. Meredith said it <br />is not uncommon for construction workers to have side jobs but she did not believe the garage
