Mr. Mackey clarified with the applicants that the rentals would only include trucks and trailers, <br />not other kinds of equipment. Mr. Papotto asked if more screening would be installed along the <br />east side of the property to help shield the houses. The applicant stated that the current <br />landscaping includes pine trees, Mr. Papotto would like more installed if possible. Mr. Allain <br />was glad the trucks will not be parking in front of the building. <br />Mr. Papotto moved, seconded by Mr. Mackey, to approve the use variance for an accessory <br />outdoor display and storage in the B-1 Local Business district as described in the letter <br />dated Apri127, 2018 for 18-10731; Ace Hardware; 23200 Lorain Road, motion passed 3-0. <br />RESIDENTIAL APPEALS AND REQUESTS <br />18-10798; A1 & Gail Jirka; 4685 Dover Center Road <br />Representatives: A1 & Gail Jirka, owners; Bill Piar, 4667 Dover Center Road <br />Proposal consists of a fence in the front yard. Property is zoned A-One Family Residence. <br />The following variance is requested: <br />1. A 10 inch variance for height of a front yard fence; code permits height of 30 inches, applicant <br />shows 40 inches, Section 1135.02(d)(2). <br />Mr. Aspery said the applicant is seeking a variance to retain the 40-inch high split rail fence <br />currently installed in their front yard along the northern property line. Code allows a maximum <br />fence height of 30 inches in a front yard, therefore requiring a variance of 10 inches to retain the <br />fence as currently constructed. Mr. Jirka stated that the fence was installed by a contractor and he <br />was unaware that it was not code compliant. The ground level varies requiring different fence <br />heights to appear level. They did not want the fence to be lowered because it would be more <br />difficult to maintain the yard underneath and cutting the tops off of the fence posts would detract <br />from the aesthetics of the fence. The fence does not encroach on the neighbor's properly. Mr. <br />Piar stated that his properly is eight feet away from the fence. He was concerned about the height <br />of the fence and how it may affect visibility while driving down Dover Center Road. Ms. Jirka <br />did not think the fence obstructs visibility because it is a split-rail fence that does not go all the <br />way to the sidewalk. Mr. Papotto thought that the open nature of the fence makes the variance <br />request not excessive. Mr. Mackey thought the fence was aesthetically pleasing and did not think <br />it was obstructive. Mr. Allain did not think it was an excessive request. <br />Mr. Mackey moved, seconded by Mr. Papotto, to approve the following variance for 18- <br />10798; A1 & Gail Jirka; 4685 Dover Center Road: <br />1.
