Which is in violation of Oad. 90-125 sections (1135.08 (A)) and (1135.07 (A)). <br />Mr. Quinn, with Aero-Tech Construction, and Mr. Walfers a neighbor each came forwazd to <br />be sworn in and address the request. Mr. Quinn indicated that Ius ciient is an amputee and she <br />can not access sections of her home any longer. The addition is to accommodate her disability <br />and to allow his client to be independent. Mr. Walters asked to see the plans as the notice <br />stated that the home is to be 23 feet from his property. Mr. Quing reviewed the pla.ns with the <br />neighbor and advised that the rear yard distance is the preexusting garage. The watls attaching <br />the garage would be fire rated as required by code and the inside wa11s of the garage would be <br />dry-walled accarding to code. The size of the addition is dicta.ted by the distance to the garage <br />to make sure his elient does not have to go outside to access her garage. Mr. Walters sta.ted he <br />had not objections to the addition. <br />M. Diver moved to grant Carol Ward of 5722 Decker Road her request for variance <br />(1123.12), which consists of a residential addition and that the following variances are <br />granted: <br />l. A 90.3 square foot variance for total lot coverage of a residence (26%), (code permits <br />2165.5 sq ft, applicant shows 2255.8 sq ft), section (1135.08 (a)). <br />2. A 26 foot 11 inch variance for a residence too close to rear property line, (code <br />requires 501, applieant shows 231.111), section (1135.08 (A)). <br />3. A 4 foot variance for total required side yard setback, (code reqnires 15', applicant <br />shows 111). Section (1135.07 (A)). <br />Which is in violation of Ord. 90-125 sections (1135.08 (A)) and (1135.07 (A)). J. Maloney <br />second+ed the motion, whiclx was unanimously approved. Variances Granted <br />14. Suburban Collision Center; 26618 Brooknark Road Ezt. (VM 1) <br />Request for variarice (1123.12). The proposal consists of addition to rear of building. <br />The following variance is requested: <br />• A special permit to add to a non-conforming building, section (1165.02). <br />Note: Existing Structure was granted a 37 foot variance for front yard setback on 2/4/99. <br />Mr. Frye with Bennett Dover, and the following neighbars Mr. Terakedis, Mr. Schmidtke, <br />each catne forward to be swom in and address the request. Mr. Frye indicated that his client <br />would like to be allowed to add to a non-conforming buildi.ng. Everything will match the <br />existing structtue and the need for the bays is to move the paanting rooms from the Dover <br />Road location to the Brookpark Road site. His client is trying to adjust the two sites to <br />accommodate the work load and clean up the sites. Mr. Terakedis requested that the variance <br />be denied as the business was a burden to the neighbors. The level of noise from the site and <br />the site constantly being a mess and not maintai.ned would worsen. The residents are <br />concemed that the fiimes froFn the shop would cause tlie neighbors heatth problems. <br />Increasing the size of the building would only bring the noise and inesses closer to the <br />residents. Mr. Schmidtke voiced that he agreed with Mr. Terakedis concerns. Mr. Maloney <br />read aloud a note from Ms. Hejnal voicing the following concerns; fumes from paint as she is <br />allergic to paint, the noise levels gncreasing and the trash which is not cleaned up now. Mrs. <br />Diver questioned if there was any painting currently at the site. Mr. Frye was not sure if there <br />was painting at the site. Mr. Kremzar voiced tha.t the request was substantially adding to the <br />non-conformity of the building. The applicant knew he was creating a non-confornung <br />bnilding when he a.dded onto the front of the building. Mr. O'Malley advised that although <br />the front of the building is non conforming the back of the site does conforn2 to code and the <br />10 of 13
