Which is in violation of Ord. 90-125 section (1135.08 A). W. Kremzar seconded the <br />motion which was unanimously approved. Variance Granted <br />12. William & Pam Chesar; 28469 Hollv Drive: (WRD 3) <br />Request for variance (1123.12). The proposal consists of a shed. <br />The following variances are requested: <br />1. A 65 square foot variance for a shed larger than code permits (see note), (code permits 56 <br />sq ft, applicant shows 120 sq ft), section (1135.02 (D1)). <br />2. A 5 foot variance for a shed located too close to rear property line, (code requires 10 <br />applicant shows 5'), section (1135.02 (D4)). <br />Note: Square footage of shed includes a 4'x10', 40 sq ft porch. <br />Which is in violation of Ord. 90-125 sections (1135.02 (D1)) and (1135.02 (D4)). <br />Mr. & Mrs. Chesar the owners each came forward to be sworn in and address the request. Mr. <br />Chesar indicated that he would like to have their shed located in the back so that it is not in the <br />middle of the yard. Neighboring properties have their sheds located in the same manor and <br />each of the abutting neighbors voiced that they did not have any objections to the shed. The <br />shed would be properly drained and the porch which is mentioned is to improve the <br />appearance of the shed. Mrs. Diver asked why the porch was needed. Mrs. Chesar stated that <br />when the shed was first purchased she thought the shed was 10'x12' shed and found that the <br />porch accounted for 4 feet of the measurement. Mrs. Diver and Mr. Kremzar felt that if the <br />porch was removed the shed could be moved forward to meet code. Applicants were asked if <br />the shed could be placed at the other side of the yard. Mrs. Chesar stated that the other side of <br />the home has an addition and they are trying to make sure they don't block their neighbor's <br />views by placing the shed in the middle of the yard. <br />W. Kremzar moved to grant William & Pam Chesar of 28469 Holly Drive their request <br />for variance (1123.12), which consists of a shed and that the following variances are <br />granted: <br />1. A 65 square foot variance for a shed larger than code permits (see note), (code <br />permits 56 sq ft, applicant shows 120 sq ft), section (1135.02 (D1)). <br />2. A 5 foot variance for a shed located too close to rear property line, (code requires 10 <br />`, applicant shows 51), section (1135.02 (D4)). <br />Note: Square footage of shed includes a 4'x101, 40 sq ft porch. <br />Which is in violation of Ord. 90-125 sections (1135.02 (D1)) and (1135.02 (D4)). J. <br />Maloney seconded the motion, which was unanimously denied. During roll call Mr. <br />Kremzar voiced that he felt that if the 4 foot porch was removed the applicants could <br />move the shed forward to only need a 1 foot variance. Mrs. Diver voiced that she agreed <br />with Mr. Kremzar. Variances Denied <br />13. Carol Ward; 5722 Decker Road: (WRD 3) <br />Request for variance (1123.12). The proposal consists of a residential addition. <br />The following variances are requested: <br />1. A 90.3 square foot variance for total lot coverage of a residence (26%), (code permits <br />2165.5 sq ft, applicant shows 2255.8 sq ft), section (1135.08 (a)). <br />2. A 26 foot 11 inch variance for a residence too close to rear property line, (code requires <br />50', applicant shows 23'.1"), section (1135.08 (A)). <br />3. A 4 foot variance for total required side yard setback, (code requires 15', applicant shows <br />11'). Section (1135.07 (A)). <br />9of13
