1. A 19.5 foot variance for an accessory structure located within a required neighbors front <br />setback on a corner lot, (code requires 50', applicant shows 30.5'). <br />Which is in violation of Ord. 90-125 section (1135.02 (DS)). <br />Mr. & Mrs. Piwarski, and Mr. Bay, a neighbor each came forward to be sworn in and address the <br />request. Mr. I'iwarski showed pictures to the boaxd to show where the garage would be placed. <br />The existing dilapidating garage needs to be replaced. '1 he garage would be a new 24' x 24' <br />garage with concrete driveway. Mr. Maloney read aloud a letter from the applicants neighbors <br />stating they had no objections to the request. Mr. Bay indicated that he had no objections to the <br />request. <br />N. Sergi moved to grant Douglas & Susan Piwarski of 23990 1Vlastick their request for <br />variance (1123.12), which consists of replacing tlae ezisting garage and that the fvllowing <br />variance is granted: 1. M. Diver seconded the motion, <br />which was unanamously approved. <br />2. James Folev; 3270 Clague Road: W1 <br />Request for vaxiance (1123.12). T'he proposal consists of a new fence on a corner lot. <br />The following variances are requested: <br />1. A 12 foot variance for a 6 feet fence located in neighbors front setback on a corner lot, (code <br />requires 50', applicant shows 38'), section (1135.02 (F2)). <br />2. A 42 inch variance for height of fence in neighbors front setback on a corner lot, (code requires <br />30", applicant shows 72"), section (1135.02 (F1)). <br />3. A variance for a fence less than 50% open in neighbors setback ori a corner lot, (code requires <br />50% open, applicant shows solid), section (1135.02 Fl)). <br />Which is in violation of Ord. 90-125 sections (1135.02 (F2)) and (1135.02 (F1)). <br />Mr. & Mrs. Foley, the owners, and Mr. Korey a neighbor each came forward to be sworn in and <br />address the request. Mr. Foley indicted that there is a chain link fence in place now which would <br />be replaced with a white vinyl fence which will have lattice atop the fence close to the house to <br />create a patio azea. The fence would only go to back of the shrubs. They have no privacy in the <br />yard as it faces the street and the size of the vinyl fence only comes to a 6-feet height. Mrs. Diver <br />reviewed that the code requires fencing much smaller and more open. Mr. Foley suggested that <br />the vinyl fencing only comes in a 6-foot height and there is not a 5-foot height, but the. lattice <br />which is open is 1-foot high. Mr. Rymarczyk indicated that there was only a sma11 section of the <br />fence that requires a variance. Mr. Maloney reviewed that the top of the fenee would be 1-foot of <br />lattice. <br />W. Kremzar moved to grant Jaanes Foley of 3270 Clague Road bis request for variance <br />(1123.12), which consists of a new fence on a corner lot and that the following variances are <br />granted as amended: <br />1. A 12 foot variance for a 6 foot fence located in neigh6ors front setback on a corner lot, <br />(code requires 50', applicant shows 38'), section (1135.02 (F2)). <br />2.
