BOARD OF ZONING APPEALS 2005 REPORT <br />Conditioned upon the sign being turned off no later than 11:00 pm, (code permits 1, applicant <br />shows 2). Which is in violation of Ord. 90-125 section (1163.27 A). W. Kremzar seconded the <br />motion, roll call on the motion J. Maloney, W. Kremzar, T. Kelly, N. Sergi "no" and M. Diver <br />"abstained", Variance Denied. J. Maloney indicated that he was against a sign on the south side <br />of the building as it would shine into the condos across the street from the site. W. Kremzar <br />believed that as a ground sign with a bulls-eye was already granted and the applicants chose the <br />location of the main sign the additional sign was not needed. 9/1/05 <br />N. Sergi moved to grant Target/Sign Lite of 24646 Brookpark Road their request for variance <br />(1123.12), which consists of wall signs and that the following variance is granted as amended: 1). <br />A variance for 1 additional Pharmacy wall sign on the west side of the building. Conditioned <br />upon it being turned off no later than 11:00 pm, (code permits 1, applicant shows 2). Which is in <br />violation of Ord. 90-125 section (1163.27 A). W. Kremzar seconded the motion, roll call on the <br />motion, J. Maloney, W. Kremzar, T. Kelly "yes", N. Sergi "no", and M. Diver "abstained" <br />Variance Granted. 9/1/05 <br />Douglas & Susan Piwarski; 23990 Mastick: (WRD 4) <br />N. Sergi moved to grant Douglas & Susan Piwarski of 23990 Mastick their request for variance <br />(1123.12), which consists of replacing the existing garage and that the following variance is <br />granted: 1. A 19.5 foot variance for an accessory structure located within a required neighbors <br />front setback on a corner lot, (code requires 50', applicant shows 30.5'). <br />Which is in violation of Ord. 90-125 section (1135.02 (DS)). M. Diver seconded the motion, <br />which was unanimously approved. 9/1/05 <br />James Folev; 3270 Clague Road: (WRD #) <br />W. Kremzar moved to grant James Foley of 3270 Clague Road his request for variance (1123.12), <br />which consists of a new fence on a corner lot and that the following variances are granted as <br />amended: <br />1. A 12 foot variance for a 6 foot fence located in neighbors front setback on a corner lot, (code <br />requires 50', applicant shows 38'), section (1135.02 (F2)). <br />2. A 42 inch variance for height of fence in neighbors front setback on a corner lot, (code <br />requires 30", applicant shows 72"), section (1135.02 (171)). <br />3. A variance for a fence less than 50% open in neighbors setback on a corner lot, (code requires <br />50% open, applicant shows solid), section (1135.02 F1)). Conditioned that the 1-foot lattice <br />will be atop the fence as presented to board and shown on plans. <br />Which is in violation of Ord. 90-125 sections (1135.02 (F2)) and (1135.02 (F1)). J. Maloney <br />seconded the motion which was unanimously approved. 9/1/05 <br />Richard Hoyer; 4445 Lansing Drive: (WRD 1) <br />J. Maloney moved to grant Richard Hoyer of 4445 Lansing Drive his request for variance <br />(1123.12), which consists of a new shed and that the following variance is granted: <br />1. A 136 square foot variance for a shed larger than code permits, (code permits 200 sq ft, <br />applicant shows 336 sq ft). Which is in violation of Ord. 90-125 section (1135.02 (D1)). N. <br />Sergi seconded the motion which was unanimously approved. 9/1/05 <br />William Scherer; 3169 Clague Road: (WRD 2) <br />W. Kremzar moved to grant William Scherer of 3169 Clague Road his request for variance <br />(1123.12), which consists of a residence with no garage and the following variance, is granted: 1. <br />A variance for a residence without a garage for at least 1 vehicle, until August l, 2006, (code <br />requires a garage, applicant shows none). Which is in violation of Ord. 90-125 section; (1161.05 <br />(A1)). T. Kelly seconded the motion which was unanimously approved. Variance Granted. <br />9/1/OS <br />17
