BOARD OF ZONING AI'PEALS 2005 REPORT <br />Rick Scrivens; 5560 Columbia Road: (WRD 4) <br />N. Sergi moved to grant Rick Scrivens of 5560 Columbia Road his request for variance <br />(1123.12), which consists of a new storage building and that the following variances are granted: <br />1. A 1000 square foot variance for an accessory storage building larger than code permits, (code <br />permits 200 sq ft, applicant shows, 1200 sq ft), section (1135.02 (131)). <br />2. A 5 foot variance for height of accessory structure, (code permits 12 ft, applicant shows 17 ft), <br />section (1135.02 (D3)). <br />Which is in violation of Ord. 90-125 sections; (1135.02 (Dl)) and (1135.02 (133)). W. Kremzar <br />seconded the motion, roll call on the motion; J. Maloney, T. Kelly, N. Sergi "yes" and M. Diver, <br />W. Kremzar "no" Variances Granted. W. Kremzar and M. Diver felt the size of the building <br />was excessive. J. Maloney felt that due to the size of the yard the size of the building was <br />acceptable. 9/1/05 <br />John McClarity; 29600 Stewart Drive: (WRD 3) <br />J. Maloney moved to grant John McClacherty of 29600 Stewart Drive his request for variance <br />(1123.12), which consists of a new fence and that the following variances are granted as <br />amended: <br />1. A 14 foot variance for a 6 foot fence located in side yard setback on a corner lot, (code does <br />not allow, applicant shows a fence). <br />2. A variance for a fence in required side yard setback less than 50% open, (code requires 50% <br />open, applicant shows solid). <br />3. A 42 inch variance for a fence higher than 30 inches in required side yard on a corner lot, <br />(code permits 30", applicant shows 72"). <br />Which is in violation of Ord. 90-125 section (1135.02 (F 1)). W. Kremzar seconded the motion, <br />which was unanimously denied. Variances Denied Mr. Maloney indicated that the height and <br />lack of openness of the fence was why the variances were denied 9/1/05 <br />Alan Teel; 5115 Andrus Ave: (WRD 4) <br />W. Kremzar moved to grant Alan Teel of 5115 Andrus Ave his request for variance (1123.12), <br />which consists of a residence with no garage and that the following variance is granted: 1. A <br />variance for a residence without a garage for 12 months September l, 2006, (code requires a <br />garage, applicant shows none). Which is in violation of Ord. 90-125 section; (1161.08 (A1)). <br />M. Diver seconded the motion, which was unanimously approved. 9/1/05 <br />Value City Furniture; 4700 Great Northern Blvd: (WRD 4) <br />J. Maloney moved to grant Value City Furniture of 4700 Great Northern Blvd their request for <br />variance (1123.12), which consists of a new wall sign and that the following requests are granted: <br />• A special permit to alter a non-conforming building (1165.02 (B 1)). <br />1. A 110 square foot variance for a wall sign larger than code permits, (code permits 100 sq ft, <br />applicant shows 210 sq ft). <br />2. A 4 foot variance for a wall sign higher than code permits, (code permits 4', applicant shows <br />8' ). <br />Which is in violation of Ord. 90-125 section; (1163.27 (C)). Approval is conditioned upon no <br />ground signs being requested for the site. W. Kremzar seconded the motion which was <br />unanimously approved.
