BOARD OF ZONING APPEALS 2005 REPORT <br />John McClari ,ty; 29600 Stewart: (WRD 3) <br />J. Maloney moved to grant John McClacherty of 29600 Stewart his request for variance <br />(1123.12), which consists of a new fence and that the following variances are granted as <br />amended: <br />1. A 15 foot variance for a fence higher than 30" and less than 50% open in a 25' required <br />setback on a corner lot, (code permits 0, applicant shows 15'). <br />2. A variance for a fence in required side yard setback less than 50% open code requires 50% <br />open, applicant shows 25% open (4-inch fence boards with 2-inch spacing between each <br />board. <br />3. A 30" variance for a fence in required side yard setback higher than 30", (code permits 30", <br />applicant sows 60"). The entire fence is to be no higher than 5 feet tall. <br />Which is in violation of Ord. 90-125 section (1135.02 (F 1)). N. Sergi seconded the motion, roll <br />call on the motion; J. Maloney, W. Kremzar, T. Kelly, N. Sergi "yes" and M. Diver "no". <br />Variances Granted 10/6/05 <br />George Dodas; 5596 Burns Road: (WRD 3) <br />W. Kremzar moved to grant George Dadas of 5596 Burns Road his request for variance <br />(1123.12), which consists of a new garage on an existing slab and that the following variance is <br />granted: 1. A 5 foot variance for a private garage too close to rear property line, (code requires <br />10', applicant shows 5'). Which is in violation of Ord. 90-125 section (1135.02 (C2)). N. Sergi <br />seconded the motion which was unanimously denied. Variance Denied Note: Mrs. Diver <br />advised that the applicant did not show there was a hardship to meet code it is just the expense of <br />moving the slab he does not want to deal with. Prior to leaving the applicant requested the board <br />reconsider their denial as he did not feel he should have to build the garage to today's code. <br />Board members advised there was no reason for reconsideration. 10/6/05 <br />Saturn ofNorth Olmsted; 27000 Lorain Road: (WRD 1) <br />J. Maloney moved to grant Saturn of North Olmsted of 27000 Lorain Road their request for <br />variance (1123.12), which consists of relocating one light pole and that the following variances <br />are granted as amended: <br />1. An 86.2 foot candle variance for parking lot lighting, (code permits 5.0 fc, applicant shows <br />91.2 fc). <br />2. A 9.8 foot candle variance for light trespassing on other property, (code does not permit, <br />applicant shows 9.8 fc). <br />Which is in violation of Ord. 90-125 section (1161.12 (C)). The fixture causing the higher light <br />readings across the property line will have a shield placed on the light. W. Kremzar seconded the <br />motion, which was unanimously approved. 10/6/05 <br />Jennifer Convertible; 26037 Lorain Road: (WRD 4) <br />W. Kremzar moved to grant Jennifer Convertible of 26037 Lorain Road their request for variance <br />(1123.12), which consists of a new sign and that the following variances are granted: <br />1. A variance for 3 signs on a unit (2 additional), (code permits 1, applicant shows 3), section <br />(1163.27 (A)). <br />2. A 34 square foot variance for total square footage of wall signs on a unit, (code permits 56 sq <br />ft, applicant shows 90 sq ft), section (1163.24 (C)). <br />Which is in violation of Ord. 90-125 sections (1163.27 (A)) and (1163.24 (C)). J. Maloney <br />seconded the motion, roll call on the motion; W. Kremzar, T. Kelly, M. Diver J. Maloney "yes" <br />and N. Sergi abstained. Variances Granted 10/6/05 <br />NOVEMBER 3, 2005 <br />19
