A 199.25 foot variance for ground signs too close to each other (sign #7 on mall prop.), (code <br />permits 200', applicant shows 9"). <br />12. A 105 foot variance for ground sign too close to each other #2 exist Westfield sign on mall <br />property, (code requires 200', applicant shows 95'). <br />Which is in violation of 90-125, section (1163.26 A). J. Maloney seconded the motion, roll call <br />on the motion; W. Kremzar, T. Kelly, J. Maloney "yes", N. Sergi and M. Diver "no". Variances <br />Granted. 4/7/05 <br />W. Kremzar moved to grant Developers Diversified of 26437 Brookpark Road their request for <br />variance (1123.12), which consists of new ground signs and that the following variances are <br />granted: <br />13. A variance for 12 ground signs on a lot (mall property) (see note), (code permits 2, applicant <br />shows 12). <br />Which is in violation of 90-125, section (1163.26 A). T. Kelly seconded the motion, roll call on <br />the motion, T. Kelly, W. Kremzar, J. Maloney "yes", and M. Diver, N. Sergi "no". 4/7/05 <br />N. Sergi moved to table Developers Diversified of 26437 Brookpark Road their request for <br />variance (1123.12), which consists ofthe following variances: <br />1. A variance for ground sign #5 within the 35 foot line of sight, (code does not permit, <br />applicant shows 1) section (1163.17 (A)). <br />2. A variance for ground sign #5 within the 35 foot line of sight, (code does not permit, <br />applicant shows 1), section (1163.17 (A)). <br />6. A 13 square foot variance for a ground sign larger than code permits (sign #4), (code permits <br />50 sq', applicant shows 63 sq') section (1163.26 (C)). <br />7. A 13 square foot variance for a ground sign larger than code permits (sign #5), (code permits <br />50 sq', applicant shows 63 sq') section (1163.26 (C)). <br />Which is in violation of 90-125, section (1163.26 (C)) and (1163.17 (A)). M. Diver seconded the <br />motion, which was unanimously approved. Issues Tabled <br />Note: The variances are being tabled to allow the applicant an opportunity to do additional <br />studying on the issue. 4/7/05 <br />Dominic Ruccella; PP# 234-23-010 and 234-23-013 Stearns Road (WRD 3): <br />M. Diver moved to grant Dominic Ruccella of PP# 234-23-010 and 234-23-013 Stearns Road <br />their request for variance (1123.12), which consists of lot split and consolidation and that the <br />following variance is granted: <br />1. A 0.64 foot variance for a lot width, (code requires 70.00', applicant shows 69.36'). <br />Which is in violation of 90-125, Section (1135.05 (a) (1)). T. Kelly seconded the motion, which <br />was unanimously approved. Variance Granted 4/7/05 <br />Andv's Auto Wash; 28800 Lorain Road; (WRD 1) <br />N. Sergi moved to grant Andy's Auto Wash of 28800 Lorain Road their request for variance <br />(1123.12), which consists of a driveway expansion and that the following variance is granted: 1). <br />A 10-foot variance for side yard setback, for a driveway too close to non-residential property line, <br />(code requires 10', applicant shows 0'). <br />Which is in violation of 90-125, Section (1139.07).
