BOARD OF ZONING APPEALS 2005 REPORT <br />Which is in violation of Ord. 90-125 section (1161.05 (w)). W. Kremzar seconded the motion, <br />which was unanimously approved. Variance Granted 5/5/05 <br />Smokey Bones; 25785 Brookpark Road: (WRD 4): <br />N. Sergi moved to grant Smokey Bones of 25785 Brookpark Road their request for variance <br />(1123.12), which consists of a sign package and that the following variance is granted: 1. A <br />variances for 3 wall signs on a building, (code permits 1, applicant shows 3). Which is in <br />violation of section (1163.27 (A)). M. Diver seconded the motion, which was unanimously <br />approved. Variance Granted. 515105 <br />W. Kremzar moved to grant Smokey Bones of 25785 Brookpark Road their request for variance <br />(1123.12), which consists of a sign package and that the following variances are granted as <br />amended: 2. A 6 inch variance for a sign higher than code permits (sign A), (code permits 4', <br />applicant shows 4' 6"). 4. A 6 inch variance for a sign higher than code permits (sign C), (code <br />permits 4', applicant shows 4'6"). Which is in violation of Ord. 90-125 section (1163.27 (C)). <br />W. Kremzar seconded the motion, roll call on the motion; J. Maloney, W. Kremzar, T. Kelly M. <br />Diver "yes" and N. Sergi "no". Variances Granted. 5/5/05 <br />N. Sergi moved to grant Smokey Bones of 25785 Brookpark Road their request for variance <br />(1123.12), which consists of a sign package and that the following variance is granted: 3. A 1 foot <br />6 inch variance for a sign higher than code permits (sign B), (code permits 4', applicant shows <br />5'6"). Which is in violation of Ord. 90-125 section (1163.27 (C)). W. Kremzar seconded the <br />motion which was unanimously approved. Variance Granted. 5/5/05 <br />J. Maloney moved to grant Smokey Bones of 25785 Brookpark Road their request for variance <br />(1123.12), which consists of a sign package and that the following variance is granted as <br />amended: 5. A variance for total square footage for total signage on a building, Total will be <br />calculated by the Building Department. Which is in violation of Ord. 90-125 section (1163.24 <br />(B)). W. Kremzar seconded the motion, which was unanimously approved. Variance Granted. <br />5/5/OS <br />JUNE 2, 2005 <br />Joseph & Vickie Mate; 23281 Marion Road: (WRD 2) <br />W. Kremzar moved to grant Joseph & Vickie Mate of 23281 Marion Road their request for <br />variance (1123.12), which consists of an addition to the existing house and that the following <br />variances are granted: <br />• A special permit to add to a non-conforming building (1165.02). Note: The existing house <br />only has a 38-foot front setback (1135.06 (A)) and only a 15-foot side setback on a corner lot <br />(1135.06 (B)). <br />1. An 8 foot variance for a residence too close to rear property line, (code requires 50 ft, <br />applicant show 42 ft), section (1135.08 (A)). <br />2. A 10-foot variance for an addition within required side setback on a corner lot, (code requires <br />25 ft, applicant shows 15 ft), section (1135.06 (B)). <br />Which is in violation of Ord. 90-125 sections (1135.08 (A)), and (1135.06 (B)). M. Diver <br />seconded the motion, roll call on the motion J. Maloney, W. Kremzar, N. Sergi, M. Diver "yes", <br />and T. Kelly "no". Variances Granted 6/2/05 <br />Developers Diversified; 26437 Brookpark Road: (WRD 4) <br />W. Kremzar moved to grant Developers Diversified of 26437 Brookpark Road their request for <br />variance (1123.12), which consists of new ground signs and that the following additional variance <br />is granted: 1. (47) A 9 square foot variance for a sign larger than code permits (sign #5), (code <br />7
