I don't see how this ordinance benefifs a single resident af <br />Norfih 09msted. Until the city's master plan is complete, I don't see how we can change n <br />code of fhis nature. It msa5t be clenrly unclerstood that this ordinance would allow <br />"sandwech shops" to be located on residenticl streets uncilor abufifiing residential <br />properties. One must be concerned in the mcnner that our residential streets are being <br />deve0oped. It seems that every six months to a year, the city is attempting to rezane <br />residerotial side streets. This has occurred more than ever in our city's history. North <br />Oimsted already has an abundance of gen¢ral business Arens that continue to sprnwl fram <br />one end ofi town to the other. Ts it really necessary to Ief this sprawl interrupt the heart <br />and soul of our city - the residents? It seetns that fhe City is willing to concede to any <br />developer's request ut rezaning, with ma regard to the residents. I wouid like to live in a <br />ciiy where the main concern Es for the residerefi. <br />This propased nmendment is wriften in such a vague way that leaves many questions <br />unanswered. It aloes not fully specify issues such as hours of operatian, hours that <br />delivQry trucks may enter the premises, drove-thru service, on-site consumption of food <br />(including in parked vehicles on site), trash disposal, houv the smaller site size would affect <br />set-back flrditwnces - especialBy with corecern to residential properfies. VVhile it attempts <br />to specifiy acceptable cooking methods, it is r?ot specific erzough, and does not include <br />reguinfiions on rood storage. I den't see, as a city, howr we can use heatin5 methads of <br />¢ood as a determining factor in land use and/ar zoning. For exampls, how would Q sma{i <br />pizza shop be categorized using ovens as their sole henting method. Does the ciiy have <br />inspectors able to closely regulate this? Is the cemmission awnr°e that the Cuyahogn <br />Counfy Banrd of Health would consider this as n Level 3 Risk Classification? For those of <br />you wrho are not aware, there nre orofy four levels af risk, with Level 4 being the highest <br />level of risk. <br />After reviewring some of our neighboring cities' ordinances perfaining to zoning af <br />resfiauranfs, you rnay find it interesting that LM of these use.hea#ing methods ns a <br />determining fnctor to clnssify their restnurants. However, they nll had clearer <br />definitions ns to what is and is nof allowed, usith strong restrictions to prohibit their <br />location near° residential properties and streets. I am sure that if this proposed ordinance <br />were to be presented to the residents of this community in a clear manner that outlined <br />the risks and liberties Ieft ta the city's discretion, rnost would be outraged. I am quite <br />confident that a petition against fhis ordiraance couid easily be obtained, if such a petition <br />would have relevance to the planning commission. in closing, let's not allouu restaurants of <br />any nature destroy the tranquility of what is left of our residential areas. <br />? <br />? ?/? 05
