I also recommend that our Commission forward the proposal to the Landmarks <br />Commission for their review and comments. <br />Ms. Wenger said the variances are categorized as follows: 1 use variance, 4 setback variances, 2 <br />lighting variances, 4 signage variances and 1 other variance are necessary. <br />Mr. Conway reviewed the following variances: <br />1. Use variance for parking/storage of vehicles on residentially zoned land <br />2. Building setback on Lorain Road <br />3. Building setback on Porter Road <br />4. Parlcing setback on Porter Road <br />5. Parking setback on north property line <br />6. No loading/unloading zone <br />7. Illumination level <br />8. Lighting minimum distance from property line <br />9. Wall signs on building <br />10. Ground signs on lot <br />11. Ground sign too close to right-of-way <br />12. Ground sign within line of sight <br />The applicant said there are light shields on all the fixtures that are adjacent to the property. <br />All fixtures are 85 degree cut off. The applicant is expected to appear before Planning <br />Commission before he goes to the BZA for his variances. The BZA is looking for a practical <br />hardship standard for area variances from the code. They are looking for an unnecessary <br />hardship standard for the use variances. The BZA proceeds more with a judiciary fashion to <br />examine the constitutionality of our zoning code as it applies to the applicant. The standards <br />that Planning Commission are much different than those of BZA. He informed the applicant to <br />look at how these variances impact the plan. <br />Mr. Steve Suhayda, architect, and Ron Kula, Kia Manager came forward are looking to expand <br />the showroom by 11,000 square foot addition and have a service area. They are expanding the <br />car storage area to the north on Dewey and Porter Roads. This encompasses the removal of two <br />buildings on the corner to allow for the addition. Landscape plan amendments were <br />recommended by Architectural Review Board including increasing plantings on Lorain and <br />Porter Roads to include honey locust trees and taxus. Lighting has remained the same on Lorain <br />Road. Some fixtures on the interior lot have been revised as well. <br />Mr. O'Malley suggested that building pertnits not be issued unless lot consolidation is <br />accomplished. Mr. Suhayda was under the assumption that the lot consolidation is done after <br />approval is completed. He said if they did it prior and were not approved, all that would be done <br />for nothing. Ms. Wenger stressed that the consolidation is not before the Board this evening. <br />The Commission should evaluate the proposal as if the lots were consolidated. Mr. Kula said <br />they are planning on consolidating all parcels as necessary. Mr. Yager asked the other members <br />if there is a property against the northern mound on Dewey that needs addressing right now. Mr. <br />Conway said there is one lot to the north that was not addressed in the use variance that was
