, ?. <br />The proposed consolidated parcel will conform to the frontage, depth and area requirements <br />of the Zoning Code. <br />Department Reports: <br />Ms. Wenger reported that the purpose of the lot split and consolidation was to create a single <br />parcel for the development of a single family residential subdivision (cul-de-sac) with access <br />onto Stearns Road. The lot split involves splitting a parcel fronting Stearns Road into two <br />parcels. The existing parcel does not conform to the City's Zoning Code for frontage <br />requirements, it is short of the 70 foot requirement by 6 inches. Therefore, the lot proposed <br />to be created would not meet zoning frontage requirements, although it would conform to <br />depth and area requirements. The second part of the proposal would be to combine the <br />remaining parcel with the abutting consolidation parcel which has frontage on Stearns Road. <br />The consolidated parcel would conform to all City zoning requirements. <br />Mr. Durbin indicated that the majority of the lots in the area were also deficient in width. If <br />the plans are approved they would require variances. <br />Mr. O'Malley reviewed that section (1101.07 (D 3)), stated that if the lot being created <br />doesn't conform, it requires the applicant go before the Board of Zoning Appeals for a <br />variances even though it is preexisting. He advised that a variance would need to be sought <br />prior to Planning Commission granting an approval or an approval could be granted subject <br />to the variances being granted. With the contingency that the plat map be retained or held by <br />the Engineering Department until a variance is granted. He further advised that the <br />commission could act upon the request even though the applicant was not present. <br />Board Members Comments: <br />Mr. Lasko stated that if an applicant does not have t?he common courtesy to show up to <br />address their plan with the commission, how, ever trivial it may seem?to them. He would have <br />not choice, but to vote no on any motion made. There are abutting neighbors present to <br />address the request however the landowner has not shown up. As a matter of principal he <br />would vote to table the issue or vote against any approval. Other board members voiced that <br />they agreed with Mr. Lasko's statemerit. Ms. Wenger advised that although no one knew <br />why the applicant was absent, she would like the commission to send the proposal forward to <br />the Board of Zoning Appeals in the interest of keeping the meetings flowing. <br />Audience Comments: ' <br />Ms. Pavlovic a neighbor came forward to voice a concern that a surveyor was at the site and <br />told her that her lot was only 61-feet wide. This being her first home, she is concerned that <br />she was not legally sold the proper size lot width. Mrs. Hoff-Smith advised the applicant that <br />her lot was an existing non-conforming lot. Ms. Pavlovic is also concerned that the driveway <br />would be right next to her driveway and the lights would be shining in her windows and <br />noise levels would also be increased. <br />R. Koeth moved to table Lot Split & Consolidation Plat for Permanent Parcel No. 234- <br />23-010 and 234-23-013 on Stearns Road. M. Yager secondecl the motion roll call on the <br />motion; M.
