Mr. Kula said they understand about the lot consolidation, however, they are still in the process <br />of negotiating other parcels that may be picked up. They realize that they cannot get building <br />permits until they consolidate all properties. Mr. Spalding said another concern is if buildings <br />are demolished, what would the City be left with. <br />Mr. Durbin said consolidation plats need to be reviewed by Engineering as well as County <br />Engineer's office before it can be recorded. <br />The following residents came forward with comments: <br />James Maxim, Dewey Road likes the idea of keeping the fence as well as the addition of trees <br />and asked if the fence can be stepped down to a 10' instead of a 6', to create a continuous <br />mound. He doesn't feel that a gate is needed in the fence. Ms. Hoff-Smith said we will follow <br />the City Forester's recommendations on the size and distance of the trees. She asked the <br />applicant what his intention was with the gate. He asked if the gate would be locked. One <br />day he envisions having an area with a picnic table for the employees. Mr. Lasko suggested that <br />the gate could be locked when the dealership is closed. Mr. Kula does not anticipate pedestrians <br />going through there, and therefore, would like the gate to be unlocked. Mr. Kula said this area is <br />not considered a constant traffic pattern area. Mr. Maxim said traffic does not occur during <br />business hours. Ms. Hoff-Smith informed Mr. Maxim that if this becomes an issue, he should <br />contact the applicant. Mr. Maxim prefers to see consolidations done prior to the approval of the <br />land. This would enable the residents to have the opportunity to malce comments as to what is <br />being consolidated. Once the plans are approved, the residents would not have an opportunity to <br />view it or malce comments. Mr. Laslco indicated that this is the reason this proposal will return <br />for another meeting. Robert Hebebrand, Dewey Road, asked where the dumpster is. The Commission <br />answered by saying it is already in place and will be staying in the same location. <br />Ken Felleisen, Porter Road provided the applicant copies of ordinances for sound and deliveries <br />to commercial establishment's ordinances. No deliveries are allowed between 9:30 p.m. - 7:30 <br />a.m. He mentioned that Halleen currently receives deliveries later than that. He submitted the <br />sound ordinance also because there will be rio 'mound along the north side of the property from A <br />& K Tire building to Porter Road. He understands that cars cannot be parked near the fence <br />because the variance was not granted. He also asked what was going to be done about the <br />Goodyear sign that was sitting behind the A& K building. He said the applicant does not feel <br />they need to maintain it. , i <br />Bop Trapp, Porter Road read a statement that he had prepaxed. In this report, he mentioned that <br />the Planning Commission has a lot of power. He stated his frustration that the government is <br />unable to help the residents. After sitting in on several' ineetings, it wa's noted that if residents <br />malce unreasonable demands, that the applicants would file lawsuits and usually prevail because <br />they are the legal property owners. It seems as if justice is predetermined prior to the case being <br />presented to the Commission. He indicated that if questions are not asked, answers are not <br />provided. Mr. Trapp questioned if Council could find out why Halleen urchased a piece of <br />land-locked residential property. <br />4
