Department reviewed the proposed paint booth locations proximity to the other stores. Mr. <br />Blazek said the buildings were fully equipped with sprinklers and the walls will meet fire <br />code ratings. Mr. Lasko advised that due to the close proximity to the City Club and Bob <br />Evens restaurant odors, fumes and other issues could have a negative impact on neighbors. <br />Therefore odor, emission and Fire Department reports will be required. Mr. Blazek felt that <br />as they were not in proximity to residential neighborhoods where people are outdoors there <br />should be no odor issues. They will follow all fire, paint booth, and building code <br />requirements pertaining to ventilating. <br />Ms. Wenger advised that although the apartment/condo complex near the site was not <br />notified they are one parcel away from being notified so there is an issue of residents. The <br />commission is concerned how cars would be parked, stored and maneuvered around the site <br />as they are being worked on without affecting the existing businesses at the site. If parts are <br />backordered cars could start stacking up as the tenant is taking in work. The applicants <br />believed that it was a one man operation with a small office and one work station which can <br />only do so much work at a time. If his business grows he would have to expand or move to a <br />larger location. Mr. Cotner felt that the tenant should be present to address the cominission <br />as neither the architect nor owners are car repairmen or know exactly the extent of work that <br />will be taking place in the garage. Mr. Reports said that they would address the rooftop units, <br />landscaping and require the tenant to be present for the next meeting. Mr. Lasko voiced that <br />the commission was requesting a report from the Fire Department pertaining to the proposed <br />plans. Furthermore the commission would table the matter until all required documents and <br />reports are submitted for both the development and the conditional use permit. <br />The clerk gave the applicant a copy of the conditional use permit requirements as well as a <br />copy of the proposed changes in Ordinance 2006-162 to assist them in understanding what is <br />required to be submitted. <br />J. Lasko moved to table Brooklor LLC.; PP# 236-01-002 Lorain Road their proposal <br />which consists of a conditional use permit and exterior modifications to existing <br />building to accommodate a new auto repair shop. G. Malone seconded the motion <br />which was unanimously approved. <br />VI. COMIVIUNICATIONS: <br />? Ordinance No 2006-162: <br />An ordinance amending chapter 1118 of the Zoning Code in order to update and change the <br />procedure for granting and revoking conditional use permits. <br />Ms. Wenger reported that through the advisory committee's ongoing review of the city <br />ordinances sections arise which have not been kept up to date with current codes. She has <br />submitted an entirely new chapter 1118. The update includes standards which each district <br />will fall into. New procedures in 1118.02 will reference chapter 1126 which all applicants <br />must follow. A section reviews a cohesive procedure for giving public notices. Under <br />approval the roll of Council is enhanced and allows Council to request and receive additional <br />testimony and evidence when administering their determination. Section 1118.03 lists <br />general issues which can apply to any use. Subsection G gives Planning & Design <br />Commission the ability to place conditions on approval which will assist in lowering possible <br />impacts to neighboring properties. <br />10
