Her concerns relating to the proposal are: <br />• Storage of damaged vehicles is not clarified in the plan as to where and how long they <br />would be stored or parked. She advised the applicants that the city was currently <br />reviewing an ordinance updating provisions of chapter 1118 which will require all car <br />parts and damaged vehicles to be wholly enclosed from view. She requested the <br />commission take the new provisions into consideration when reviewing the proposal. <br />• Parking -2 spaces are removed but still within parking requirements as the scale for <br />calculating spaces have changed. However there is some parking which impedes access <br />to the dumpster and could possibly impede City Club usage which should be discussed. <br />• Concerned that there will be cars left outside and visible from Lorain Road. <br />• Mechanical equipment is to be screened from view new plans show that they are visible. <br />• Detailed findings need to be submitted to the commission. <br />• Recommendations needed for variances and special permit. <br />She recommended the commission discuss each of the requirements as described in chapter <br />1118 and to document findings to be forwarded to City Council. In addition the commission <br />would also need to make recommendations to the BZA on the special permit to alter a non- <br />conforming building as well as area variances required. <br />Mr. Rymarczyk reviewed that due to the parking lot and landscaping being altered the <br />applicants are required to irrigate the site or seek a variance. The dumpster area needs to be <br />clarified and the roof top units must be screened as mentioned. <br />Mr. Collin advised that the plans would need to note that at the east entrance there is a <br />manhole which needs to be raised and shown on the plans. There are also sections of <br />sidewalks which will need to be repaired or replaced. <br />Mr. O'Malley reviewed that there are standards which are required and should be addressed <br />by the applicant for the conditional use permit as well as the special permit to add to a non- <br />conforming building. He referenced a similar conditional use request earlier in the year <br />wfiereby scientific studies, reports and export witnesses addressing EPA standards relative to <br />pollutants, odors, noise and other things of that nature were presented. Said studies are <br />required to determine whether or not the proposed paint shop will meet EPA regulations for <br />the proposed district. Section 1138 of the code provides the commission with additional <br />conditions and restrictions as they see fit and appropriate for the use i.e. can require storage <br />of vehicles to be maintained indoors only. <br />Mr. Blazek the architect was present to address the commission. The proposal is a tenant fit <br />out to an existing service fagade within the center. When the center was first designed the <br />proposed location was a service garage. He reviewed the areas which would be affected by <br />the fit out. He suggested that the proposed location was the best placement in the center for <br />the use. The tenant is a very small business and the modifications will have a small office <br />and service area for working. He suggested that he had read the articles related to the last <br />conditional use for an auto body shop. He said the commission could be assured that they <br />will comply with any and all requirements related to installing the service garage equipment. <br />In regards to being requested to try to beautify the area they will be constructing an enclosed <br />trash dumpster'that will match the enclosure to the south of the site. Trying to address <br />Landscaping along Lorain Road is very tight due to the grading changes and the fact that <br />there is a retaining wall. There will be no irrigation as they will use the same planting <br />8
