BOARD OF ZONING APPEALS MOTION <br />2006 INDEX <br />Fifth Third Bank; 26187 Lorain Road: (WRD # 4) <br />N. Sergi moved to grant Fifth Third Bank of 26187 Lorain Road their request for a special permit to add to a <br />non-conforming building section (1165.02 (b)(1)) as well as their request for variance (1123.12), which <br />consists of an additional ATM drive-through lane and that the following variances are granted as amended: <br />1. A 17 foot 10 inch variance for rear yard setback, code requires 50', applicant shows 32'.2"), section <br />(1139.08 (g)). <br />2. A variance for conducting business activity in the rear yard, (code does not permit, applicant sows <br />business activity), section (1139.08 (g)). <br />4. A 17.8 foot candle variance for excessive illumination under canopy, (code requires 15 F.C., applicant <br />shows 32.8 fc.), section (1161.12 (C)). <br />5. A variance for lighting being left on all night without reduction,(code requires 50% reduction, applicant <br />shows none), section (1161.12 (j)). <br />Which is in violation of Ord. 90-125 sections; (1139.08 (g)), (1139.14), (1161.12 (C)) and (1161.12 (j)). J. <br />Maloney seconded the motion roll call on the motion; N. Sergi, J. Maloney, M. Diver, T. Kelly "yes" and J. <br />Burke "no". Variances and Special Permit Granted 10/5/06 <br />NOVEMBER 02, 2006 <br />The August 3, 2006 and October 5, 2006 Board of Zoning Appeals minutes were approved <br />Joe & Vickie Mate; 23281 Marion Rd: (WRD # 2) <br />N. Sergi moved to grant Joe & Vicki Mate of 23281 Marion Rd their request for a special permit to add to a <br />non-conforming building, which is in violation of section (1165.02). T. Kelly seconded the motion, which <br />was unanimously denied. Permit Denied 11/2/06 <br />Dale & Pamela Masola; 27649 Marquette Blvd: (WRD # 1) <br />J. Maloney moved to approve Dale & Pamela Masola of 27649 Marquette Blvd their request for variance <br />(1123.12), which consists of a new fence installed without a permit and the following variances are granted: <br />1. A 34 foot variance for a 6' privacy fence located in neighbors 50' setback on a corner lot, (code requires <br />50', applicant shows 16'). <br />2. A 42 inch variance for fence higher than code allows on a corner lot, (code permits 30", applicant shows <br />72"). <br />3. A variance for a fence within neighbors 50' setback less than 50% open, (code requires 50% open, <br />applicant shows solid). <br />Which is in violation of Ord. 90-125 section; (1135.02 (2)). N. Sergi moved to approve Robert Briesath of 6023 Decker Rd his request for variance (1123.12), which <br />consists of a new shed and that the following variance is granted as amended and agreed too: 2. A 2'/z foot <br />variance for a shed higher than code allows, (code permits 9', applicant shows 11 %2, which is in violation of <br />Ord. 90-125 section;(1135.02 (D 1)). M.
