CITY OF NORTH OLMSTED <br />Following..the above outline of the variances, as presented on the Board's Agenda, the Board <br />separately ruled on the items as follows: <br />• A variance to section (1165:02) as the addition does not comply with front and rear setbacks. <br />Request for variance (1123.12). The proposal consists of signage and redeveloping the site. <br />Standards: <br />1. ? Affirmative = Deny: Affirmative - applicant failed to demonstrate the absence of reasonable <br />return or beneficial use without the variance. <br />2. ? Affirmative = Deny: Affirmative - the addition square footage as it relates to the variance is <br />substantial. <br />3. ? N'egative = Grant: Negative - the character of the neighborhood would not be altered. <br />4. ? Negative = Grant: Negative - governmental services would not be altered. <br />5. ? Affirmative = Deny: Affirmative- applicant presumably had knowledge of the zoning <br />restri'ctions prior to purchase. ' <br />6. ? Negative = Grant: Negative- an addition of any size would be nonconforming to front and <br />rear setbacks, so the applicant's predicament cannot be avoided. <br />7. ? Negative = Deny: Negative - applicants proposal is unreasonable, exceeds lot coverage, <br />negatively impacts traffic safety and, as presented, would not be consistent with the spirit and <br />interit of the Code and required by substantial justice. <br />The Board vvas not opposed to expansion and improvement of the building but determined that <br />the expansion was too substantial, excessive and impacted or caused other variances requested. <br />Accordingly; based on the substantial, probative and reliable evidence on the record, and as <br />governed ?by application of the foregoing standards, and further subject to the conditions, the <br />variance.is hereby: <br />GRANTED DE1vIED <br />Following''tlie above outline of the variances, as presented on the Board's Agenda, the Board <br />separately'ruled on the items as follows: <br />1.
