2. Re.quested Building "C" &"D" be addressed together to ensure building "C" does not affect "D".
3. Goncerned that the 8 foot mound and 8 foot fence atop the mound is not enough to buffer the
illuminated signs of building "C" or "D".
4. Thought business hours should be set far the site.
Mr. Berryhill advised that La-z-Boy would close at 10:00 pm and Fatburger at 11:00 pm which
would ensure all signs would be off on the building no later than midnight. He felt setting time
limits was not warranted as they had expended a large amount of money installing mounds, fencing,
landscaping and light pole shields to buffer neighboring residents from lighting. Mrs. Sergi felt the
west La-z-Boy sign being on until midnight would place a burden on the residents. Mr. Berryhill
stated he would guarantee all signs would be turned off within 1 hour of the individual stores
closing.
Discussion pertaining to past time limits and time frames set for services to or from and on the site
took place and then the board took a break to check past minutes for possible time limits being set.
After the break Mr. Burke advised that in reviewing past minutes the members found that there was
time iines set to have all Target signs off by 11:00 pm. Mr. Berryhill agreed to guarantee that the
west La-z-Boy sign would be off no later than 11:00 pm. Mr. Skoulis felt that not enough
information pertaining to the proposed signs were known to approve the request. The residents were
invited to come forward and review the site plan showing all signage on building "C". Mr. Burke
advised that the board was sympathetic to both the business and the residents and was trying to do
what was best for everyone involved.
J. Burke moved to grant (Parcel E) North Olmsted Town Center "BLDG C" their request for
variance (1123.12), which consists of a sign package for Bldg "C" as amended and with the
following criteria: A) The condition and adoption and adherence of the landlords sign criteria
as ainended in paragraph "C" which is subject to Administrative review. B). Subject to the
sign package dated received April 4, 2007 and conditioned upon that sign package as
submitted. C). Conditioned upon all lights being turned off within 1 hour of closing with the
stipulation that the La-z-Boy west wall sign will be turned off no later than 11:00 pm.
Furthermore the following variances are granted as amended:
1. A 168.7 foot variance for excessive signage on a building "Bldg C", (code permits 163.3 sq
ft, applicant shows 332 sq ft) section 1163.24 (B).
2. A 4.3 sq ft variance for excessive square footage of signage on a unit (Fatburger tenant 2),
(code permits 77.7 sq ft, applicant shows 82 sq ft) section 1163.24 (C).
3. A variance for 1 additional wall sign on a unit (Fatburger signs c2 & c3), (code permits 1
applicant shows 2) section 1163.27 (A).
4. A'1 'foot variance for height of sign (La-z-Boy sign c5), (code permits 4 ft, applicant shows
51) section 1163.27 (C).
5. R. Menser seconded, roll call on the motion; J. Burke, R. Menser, T. Kelly
"yes" and N. 5ergi "no". Variances Granted.
2.
