their sites. They work with the police through a network setup that if something is missing they <br />broadcast the information so the recycling centers can look for the stolen items. Mrs. Meredith <br />did not believe noise levels would be an issue as abutting neighbors consists of general retail and <br />an elementary school. The previous business which was a muffler shop was much louder. The <br />night before city trash piclcup the center should stay open later to accommodate working <br />families. Mr. Laslco asked how many employees and Mr. Ivancic said there would be three <br />employees, two would assist customers and one would be the cashier. Mr. Bohlmann aslced if <br />the city had a right to revolce the permit if the conditions of the permit were not upheld and Mr. <br />O'Malley said that it could be revoked through a hearing process under section 1118. <br />The Commission addressed the conditional use permit following section 1118.03 general criteria <br />a through g and included subsections to compile a report of findings (see attached findings). <br />During the review of section 1118.03a discussion ensued related to possible traffic, noise, odors <br />and whether or not the service fit into the general retail zoning district. Concerns of the <br />proximity to Croolcer Sterns project was discussed as was the aesthetic layout of the drive <br />through bays and the center being able to cut down the collection bins scattered throughout the <br />city parking lots. There was discussion of Lorain Road traffic and vehicle stacking on the site. <br />Some members felt that the use was not appropriate in the retail district, but Mr. O'Malley <br />reminded the Commission that the policy/determination had been made by City Council. The <br />consensus of the commission found that the proposed use fit the criteria of all sections of <br />1118.03 and would be less of a negative impact to the area then the previous business which was <br />a muffler shop. However the commissioners all agreed that bin piclcup times would need to be <br />regulated to minimize traffic hazards on the site. Mr. O'Malley said city codes mandate the <br />times which commercial truclcs can malce deliveries and pickups both in the morning and <br />evening hours. Commissioners discussed how often the overhead doors would be open and <br />debated if the amount of noise from opening and closing the overhead doors would be louder <br />than having the doors left open. <br />Mr. Lasko moved, seconded by Mrs. Meredith, to approve a conditional use permit for <br />COMS08-10: B1ueStar Metal Recycling of 28820 Lorain Road based upon the <br />commission's findings and the following conditions: 1). Hours of operation 8:00 am to 9:00 <br />pm Monday through 5aturday and no Sunday or holiday hours. 2). Hours of operation <br />include all functions, both internaUproprietary as well as customer/retail operations. Roll <br />call: Lasko, Williamson,lVIalone, Rerko, Meredith - yes; Cotner, Bohlmann - no. Motion <br />approved 5-2. Mr. Lasko said though he does not like the use in that area, he was compelled by <br />the ordinance and following the facts finding to vote yes. <br />Mr. Lasko moved, seconded by 1VIr.1VIalone, to approve the proposal for COMS08-10: <br />B1ueStar Metal Recycling of 28820 Lorain Road as submitted conditionecl upon the <br />conditional use perrnit is granted.
