building design was lacking as it was too boxy and the color palette was not cohesive. Mr. Reid <br />reviewed where the colors would be used and advised that color samples would be provided at <br />the next meeting as well as pictures to show how the gas pump canopy colors would look next to <br />the building colors. He explained that the building and gas pump canopy are owned by two <br />separate entities which have their own color palettes. Mrs. Meredith felt that although the parcel <br />west of the site was zoned commercial it was used residentially therefore the west landscaping <br />bed needed to provide more buffering. <br />Ms. Desnoyer, an abutting neighbor, felt that a fence should be required along the west property <br />line as the parcel is used residentially not commercially. Mr. Malone said the development <br />would return for further review and advised the applicant to provide additional buffering along <br />the west property line. <br />Mr. Rerko said that his recommendation for rezoning would be based on no outdoor merchandise <br />displays. Mr. Lasko said the project's location is a focal point/gateway into the community. He <br />said the Commission's recommendations are based on the Master Plan as well as the Crocker <br />Stearns Corridor Plan. <br />Mr. Lasko moved, seconded by Mr. Bohlmann, to recommend City Council approve <br />Ordinance 2008-18 which is an ordinance proving for the amendment of the zoning map to <br />the City of North Olmsted by rezoning permanent parcel No. 234-20-049, located at 5764 <br />Stearns Road, from its current zoning classification of Single Family Residence District use <br />to General Retail Business District use, which was unanimously approved 7-0. <br />Mr. Lasko moved, seconded by Mr. Malone, to recommend the Board of Zoning Appeals <br />grant BP Products North America Inc of 29131 Lorain Road a 17.95 foot variance for front <br />setback (Lorain Road), code requires 20 ft, applicant shows 2.05 ft, which is in violation of <br />section 1139.07 (table), which was unanimously approved 7-0. <br />Mr. Lasko moved, seconded by Mr. Rerko, to recommend the Board of Zoning Appeals grant <br />BP Products North America Inc of 29131 Lorain Road a 1.5 foot side yard setback variance <br />for corner lot (Stearns), code requires 20 ft, applicant shows 18.5 ft, which is in violation of <br />section 1139.08(A) based on the applicants willingness to removed the eastern parking <br />space to minimize the variance required, which was unanimously approved 7-0. <br />Mr. Lasko moved, seconded by Mr. Malone, to recommend the Board of Zoning Appeals <br />grant BP Products North America Inc of 29131 Lorain Road a 10.11 foot rear building <br />setback variance code requires 50 ft, applicant shows 39.89 ft, which is in violation of <br />section 1139.07 (Table), which was unanimously approved 7-0. <br />Mr. Lasko moved, seconded by Mr. Bohlmann, to recommend the Board of Zoning Appeals <br />grant BP Products North America Inc of 29131 Lorain Road an 8,467 square foot variance <br />for lot size, code requires 40,000 sq ft, applicant shows 31,533 sq ft, which is in violation of <br />section 1139.06, which was unanimously approved 7-0. Mr. Lasko commented his vote was <br />based on the fact that the parcels in question would not be developable without variances which <br />could have been more significant.
