Mr. Lasko moved, seconded by Mr. Malone, to recommend the Board of Zoning Appeals <br />grant BP Products North America Inc of 29131 Lorain Road a variance not to exceed 3 foot <br />for conducting business in sideyard setback (air pump), code requires 10 ft, applicant shows <br />7 ft, which is in violation of section 1139.07 (Table, which was unanimously approved 7-0. <br />Recommendation regarding the drive radii was held pending the applicant redesigning the curb <br />cuts to meet code or reduce the variance required. <br />Mr. Lasko moved, seconded by Mr. Bohlmann, to recommend the Board of Zoning Appeals <br />grant BP Products North America Inc of 29131 Lorain Road a variance for light <br />trespassing property line, code does not allow, applicant show spillage, which is in violation <br />of section 1161.12(c). Roll call: Rerko, Malone, Williamson, Cotner, Bohlmann - yes; <br />Lasko, Meredith - no; motion approved 5-2. <br />Mr. Lasko moved, seconded by Mr. Bohlmann, to recommend the Board of Zoning Appeals <br />grant BP Products North America Inc of 29131 Lorain Road a 22.2 foot side building <br />setback (Stearns Road) variance, code requires 50 ft applicant shows 27.8 ft, section <br />1139.08(c), which was unanimously approved 7-0. <br />Mr. Lasko moved, seconded by Mr. Malone, to table BP Products North America Inc of <br />29131 Lorain Road pending the results of the variance requests. The applicant will address <br />the Commission's concerns pertaining to the development plan, which was unanimously <br />approved 7-0. <br />COMMUNICATIONS <br />Ordinance 2008-17 <br />An ordinance amending sections 1139.01, 1145.01, and 1145.03 of the zoning code in order to <br />establish regulations providing for the location of recycling facilities and recycling collection <br />centers in the City of North Olmsted. Note: PDC tabled 2/13/08 <br />Ms. Wenger said the zoning amendment would pernut recycling collection centers as a <br />conditional use in the general retail business district subject to various restrictions, including a <br />distance limitation from residential property, require activities be carried out entirely indoors, <br />noise control, and building size limitation, as well as any conditions associated with the <br />conditional use permit granted. Recycling facilities and collection centers would remain a <br />permitted use in the limited industrial district. The ordinance would be a two tiered approach <br />leaving a door open for the smaller businesses which are not as active as those found in the <br />industrial district. <br />Mr. Bohlmann said he is for recycling centers but not along Lorain Road. Allowing recycling <br />centers on Lorain is a detriment to the city. He believed that the use would be more commercial <br />than residential and the city already has BFI pick up recyclables. He believed that they should <br />only be allowed in the light industrial area. Mrs. Meredith believed that there was a distinct <br />difference between a recycling collection centers and recycling companies, collection centers
