3. A 2.5 foot variance for a wall sign higher than code allows; code permits 4', applicant shows <br />6.5', section 1163.28 (c). <br />Mr. Patel, the manager/owner, and Mr. Hindenburg with Euroneon Signs were sworn in. Mr. <br />Hindenburg reviewed the size and number of variances required. The Bamboo sign is 6'6" <br />inches with a 14 foot peak. They require larger signs as the abutting wall signs are <br />overpowering. If the three wall signs are any smaller they would be lost on the large farade. Mr. <br />Patel said that there are three separate restaurants each of which will have their own storefront. <br />Mrs. Sergi questioned if each restaurant would have a separate door. Mr. Patel said that the front <br />fagade would be altered so each business would have separate doors. Mr. Conway questioned if <br />the applicant had received approval to make fagade changes and Mr. Patel said his farade <br />changes were approved by DDR. The front will be entirely glass with one set of double doors <br />for Inchin's Bamboo Garden, which opens to a combined vestibule that will be shared with <br />Tadka Indian Cuisine. The Banquet restaurant has a separate set of double doors which is their <br />only ingress/egress. Mr. Conway said that the drawings did not reflect what was being discussed <br />and noted that the write-ups were based on the plans submitted. Mr. Hindenburg said he handles <br />signage and was not aware of construction. Mr. Patel said although the plans were approved by <br />DDR the elevations shown do not reflect the changes. Ms. Rudolph asked to see drawings <br />reflecting the fagade changes scheduled. Mr. Patel said he did not have the farade plans with <br />him. Ms. Rudolph questioned if the write-up needed to be altered for three separate restaurants. <br />Mr. Conway questioned if each restaurant would be separated by permanent/fixed walls, have <br />separate restrooms, kitchens and cash registers for each business. Mr. Patel said each restaurant <br />had their own restrooms, all three restaurants would share one kitchen and only the Banquet <br />would share a cash register with Bamboo Garden. Ms. Rudolph questioned if a variance for <br />three wall signs would still be required or if the square footage variance would need to be <br />changed. Mr. Conway said that he would have to research the proposal more to determine if in <br />fact there are three separate businesses. Mrs. Sergi was not comfortable addressing the request <br />without clear plans and knowing whether or not the variances as written were in fact what were <br />required. All board members agreed and felt the matter should be tabled until the building <br />department was provided more information. Mr. Conway said he wanted to view the applicant's <br />worlcing drawings to determine if what is being represented is accurate and questioned the <br />applicant's time constraints. Mr. Patel said the target date for opening was mid June. <br />Mrs. Diver said the applicant could return the first week of June with plans for the board to <br />address. Mr. Hindenburg said he was required to install the signs 30 days prior to opening. Mr. <br />Conway questioned if the applicant could meet with the Planning & Design Commission prior to <br />the board's June meeting. The Clerk noted that PDC would meet May 27, 2009. Mr. Patel said <br />DDR already approved their proposed package. Mr. Conway advised the applicant that the city <br />received documentation from DDR earlier in the day noting he was to comply with all <br />governmental regulations governing signage. Ms. Rudolph questioned if all three signs needed <br />to be installed 30 days in advance or could one sign meet the requirement. Mr. Patel said they <br />are separate restaurants which need their own signs. <br />Mrs. Sergi questioned if the three businesses were one corporation or separate. Mr. Patel said it <br />is one corporation with three different restaurants and he is a franchisee of the corporation. Mr.
