Mr. Mitchell said plans were modified to meet the City Forester's recommendations pertaining to <br />tree removal. The display parking along the front setbaclc requires a variance. The average foot- <br />candle reading for site lighting is now under five foot candles eliminating a need for a variance. <br />Although required parking spaces comply with code the parking summary needs to be corrected. <br />Mr. DiFranco said a conservation easement must be provided for the undeveloped parcel. A <br />variance is required to relieve the requirement for a conservation easement on the developed <br />parcel and a note should be added to the consolidation plat advising future owners that any <br />redevelopment is required to meet all requirements of Chapter 926. The new pavement at the <br />southeast corner requires a variance as does the storm water management pond within the <br />riparian setbaclc both of which are recommended. <br />Mr. O'Malley said although variances from Chapter 926 are required, Council does not require <br />the Commission's recommendations. Seelcing a variance for the display of vehicles is not <br />uncommon to the area or proposed business and recommended the development approval be <br />contingent upon lot consolidation approval prior to any building permits being issued. <br />Mr. Brooker said the undeveloped lot to the east will include a new curb cut and the need to <br />develop part of the restricted area is for site circulation and deliveries. The retention area was <br />previously proposed during meetings for Lotus. There will be five display pads which will <br />accommodate seven vehicles and the east area showing ten parlcing spaces within the 75 foot <br />setback will also be used for vehicle displays. A third of the east lot is undevelopable due to the <br />riparian setback. The new entrance will extend 2 feet 6 inches into the required 75 foot setback <br />and the glass awning will extend an additional5 feet into the setback. The awnings over each <br />front window will extend 5 feet from the building. Ms. Wenger requested it be noted that the <br />new 2 foot 6 inch entrance plus awning would extend 7 foot 6 inches into the 75 foot setback but <br />the east and west window awnings would only extend 2 feet 6 inches past the new entrance. <br />Mr. Rerlco said he preferred the stone cladding and liked that the back of the building would be <br />painted to match the stone cladding. Mr. Malone commended the applicant for worlcing to save <br />as many trees as possible. He wanted clarification that pavers not stamped concrete would be <br />used in the briclcscape and Mr. Brooker said they would use pavers. Mr. Malone said the <br />proposed landscaping matches the owner's sites across the street which has a good mix. He <br />aslced the square footage of permeable pavement and Mr. Brooker said it would be about 400 <br />square feet. Mr. Bohlmann asked if there would be an underground retention or drain to the <br />detention pound. Mr. DiFranco said there will be a pond in the flood plain but any water from <br />the west site will have to be stored outside the riparian area. Mr. Parry asked if a variance for 7 <br />display vehicles was required or 17. Mr. Mitchell said a variance for 17 display vehicles is <br />required. Mr. Parry asked for clarification regarding the rear drive and Mr. Broolcer said the <br />drive is provided for customers and delivery truclcs traveling around the building. Mr. Parry was <br />concerned that the severe slope along the southwest area could become a hazard when ice or <br />water builds up. He questioned if the display areas would be hard surface and Mr. Brooker said <br />they would be concrete. <br />Mr. O'Malley said that the engineer would require any trees being removed from the riparian <br />area be replaced elsewhere on the site.
