<br />shopping center to accommodate a Giant Eagle Supermarket. This will also include the added <br />screening for the roof units that was left off the drawings, and the sound proofing of the <br />compactor so that it meets the requirements of the noise ordinance and make sure it was out of <br />sight. Mr. Dubelko at that point and recommended that the motion clearly state that the <br />compactor be enclosed and that it be enclosed with such materials that are sufficient to deaden <br />sound so that at the residents property line the sound level does not exceed what is permitted <br />under the noise ordinance. Mr. Tallon told Mr. Dubelko that was basically what he had <br />requested for at the last meeting and I will put that back in the minutes again. It will be <br />enclosed and the sound baffling will protect to the noise level permitted and that those <br />materials also be the same materials the exteriors of the building ares made of with the <br />exception of any acoustical . Building Commissioner Conway ask for a clarification do you <br />mean a roof over it and two walls with one end open. Mr. Tallon answered yes that was what <br />they wanted. Mr. Brennan asked Mr. Tallon if it included the recommendation that <br />Architectural Review Board made, Mr. Tallon indicated it did include the Architectural Review <br />Boards recommendations. The motion was seconded by R. Koeth. Roll call on the motion, T. <br />Brennan yes, O'Rourke yes, Cameron-Alston yes, seconded Asseff yes, Mr. Spalding yes with <br />the following footnote, that he would like the Board of Zoning and Development to consider <br />the feasibility of adding a separate exit and entrance to the facility. <br />Ms. Kummer ask if the meeting was over and ask if she could ask Mr. Tallon a question. Mr. <br />Tallon indicated that the meeting was not over. Ms. Kummer than ask if they had just <br />approved something they hadn't seen. That they had approved the trash compactor thing, Mr. <br />Tallon indicated that it had to be done as they had been instructed to use the same materials as <br />the building and it will be inspected by the building department to make sure it is done. Ms. <br />Kummer then suggested, this is why people stop voting. Mr. Tallon suggested the <br />Commission has tried to tie-up loose ends. Ms. Kummer ask which committee Criant Eagle <br />would go before next, so the residents will knew where they were suppose to be so they can <br />hear us. Clerk told Ms. Kummer the next committee was the Board of Zoning and <br />Development. Mr. Koeth indicated that Ms. Kummer also needed to contact Mr. Limpert her <br />councilman and Mr. Gareau the Law Director with her concerns. <br />Mr. Tallon ask the other commissioners if they had their letter from the law department about <br />the factors to be considered by Board of Zoning Appeals and he instructed them to keep that <br />letter in front of them when they are working on projects that require variances to make sure <br />that we cover it. T. Brennan ask Mr. Dubelko why you can't require some level of <br />consistency when these things go from one committee to another and wasn't there a ordinance <br />proposed by councilmen Musial for these to be complete and full documentation before they <br />get anything started. Mr. Dubelko said you mean before they come before planning <br />commission. Mr. Brennan indicated yes this guy came before the corrunittee with a basic <br />building foot plan and a story. Mr. Dubelko I would say in harshest tones possible that you <br />have to use your head instead of your heart. I think what you were saying is the <br />commissioriers were feeling sorry for this guy because he was on a shoe string budget and he is <br />living on the same property. I've told different commissions over the years always plan for <br />worst case scenario. He could have put himself in the building and then a year from now <br />circumstances could change and he could bring in a tenant. Always plan for worst case <br />scenario. Mr. Tallon indicated that wherever you develop retail property you have to take into <br />consideration what the highest use of that property will be. Mr. Brennan indicated he still <br />8
