Also granted at the 7uly 2, 1998 board of zoning appeals meeting were variances for: <br />front yard setback; side yard setback; and a driveway off Canterbury Road that is not to be <br />ninety degrees to the street right-of-way. Architectural review board appreciated the amount <br />of work put into the building, but felt more emphasis should be placed on the landscaping. As <br />a result of the comments some flower beds have been added on the corners of the property. <br />Mr. Brennan noted some comments were provided by the city forester and Mr. Zergott <br />(architectural review board chairman). He questioned if W. Tyson would make the changes <br />recommended. Mr. Tyson was willing to adhere to that request but noted the building will be <br />raised which may cause some root damage. He received a copy of the foresters <br />recommendations of Ju1y 8, 1998 and agreed to do everything he can to accommodate those <br />requests. Mr. Brennan questioned if an intercom system would be in place. M.T. Tyson <br />assured the commission there would be no intercom or menu board as patrons must call ahead <br />then pick up their pizza at the window. Mr. Tallon questioned the elevation of the light poles. <br />Mr. Fisher explained they would be no higher than the building as previously recommended. <br />The bulb is proposed to be 400 watt metal halide. Mr. Tallon believed 400 watts is way to <br />high for the purpose of lighting up a driveway. Mr. Fisher agreed to reduce the lights in the <br />rear to 250 watts, and reduce the height of-all the poles to fifteen feet. Mr. Brennan <br />questioned if the residents to the rear would be able to see the roof top equipment. Mr. Fisher <br />noted the roof top equipment may stick up 12-16 inches higher and agreed to put screening <br />around all the units. Mr. Brennan noted they may not need to screen around each unit <br />completely but could possibly have some continuous screen along the north side of the <br />bu.ilding that is high enough to screen all the equipment. Mr. Spald.iug questioned if the fence <br />would be a solid or slatted fence. Mr. Fisher clarified the fence will be solid and staggered on <br />each side. Mr. Tallon opened up discussion for audience participation, but no interest was <br />expressed. <br />R. Tallon moved to approve the proposal of Douglas T. Fisher, NCARB (Donatos Pizza) <br />26170 Lorain Road to construct Donatos Fizza parlor, located on the north east corner of <br />Lorain and Canterbury, under the following conditions: the developer will work closely with <br />the forester and architectural review board in removal of the build.ing so as not to damage the <br />existing trees; the lighting on the north end ofthe property reduced to fifteen (15') feet as well <br />as 250 watts; the roof top units to the north and east are to be shielded; and this motion shall <br />include all the recommendations of architectural review board. The motion was seconded by <br />K O'Rourke and unauimously approved. In the &aming of the motion, Mr. McDermott <br />questioned if the comments from the traffic engineer regarding the alignment of the driveways <br />has been addressed. Mr. Rymarczyk clarified that has been addressed and board of zoning <br />appeals went along with the recommendation as presented by Mr. Crriffith. Mr. Asseff <br />questioned if a left hand tum will be permitted on Lorain Road. Mrs. O'Rourke noted that the <br />traffic engineer recommended that Left hand turns on Lorain be permitted. The clerk <br />announced the next step for this proposal will be the B.Z.D. committee of council, and Mr. <br />Fisher will be contacted when that meeting is set. Mr. Tyson questioned if he could start on <br />any of the work. Assistant Building Commissioner Rymarczyk advised they could pull the <br />permit to demolish the existing building, but construction of the new building is subject to the <br />approval of council.
