Brennan and <br />unanimously approved. <br />R Tallon moved to refer Sportsman's Barber Shop, 30650 Lorain Road to the board of <br />zoning appeals with the recommendation that the board of zoning appeals: grant the variances <br />to have a house without a private garage; grant the variance for the change of use; grant the <br />side yard variances for the structure/driveway; and grant the variance for the ground sign. <br />The motion was seconded by T. Brennan and unanimously approved. In the framing of the <br />motion, Mr. Tallon stated this proposal did not have to return to plauuing. The clerk advised <br />the next board of zoning appeals meeting is August 6, 1998 at 7:30 P.M. <br />N. NEW DEVELOPMENTS AND SUBDIVISIONS: <br />1) Vienna Woods Subdivision No. 4: Imnrovements & Grading Plans. <br />The proposal to subdivide sublot "A" of the Vienna Woods Lot Split into twelve (12) <br />residential lots was approved by Planning commission on June 24, 1997. Location is east of <br />Woodside Drive and south of Gessner Road. Zoning is C-Residence, Single entirely, and <br />proposed sublots conform to zoning code requirements for area and frontage. <br />Mr. Bartell presented the Improvements and Grading Plans for Subdivision number 4 in <br />Vienna Woods. Assistant City Engineer McDermott offered the following comments <br />concerning this proposal: 1) the plat will have to be re-filed to provide access easements to <br />the retention system; and 2) due to the fact there is a new ordinance requiring a greater height <br />elevation clearance for sanitary sewers and basement floor, it is necessary to raise the grade. <br />Adclirionally, he noted this change in grade will make the property involved much higher than <br />the adjacent properties. Mr. McDermott suggested an alternative consideration is to minim».e <br />the impact of this change in grade by limiting the vertical height by either having no basement <br />or split level type homes. Mr. Bartell was not in favor of this alternative layout. Mr. <br />McDermott explained, if approved, this may cause a situation where the new homes are sitting <br />noticeably higher than the adjacent homes on Gessner and the north part of Woodside Drive. <br />In response to a question from W. Spalding, Mr. McDermott noted the grade would be <br />noticeably higher and similar to the Bridgeport locarion. He stated the lighter shade on the <br />plan is the footer elevation, however a foot would need to be added for the basement <br />elevation. Mr. Brennan questioned if engineering has received many complaints regarding the <br />Bridgeport project. Mr. McDermott advised the engineer for Bridgeport has reduced the <br />grade on the rear which is an improvement, although, it is not quite what the engineering <br />department would like. Mr. Tallon questioned if Mr. McDermott's recommendation was to <br />eliminate the basements. Mr. McDermott confirmed that is his personal recommendation, but <br />Mr. Bartell said that he did not feel that was a feasible solution. Mr. Spalding questioned if <br />tlus would cause a settling problem in terms of the fill that needs to be provided. Mr. <br />McDermott agreed there would be a slight settling with the unfinished grade. Mr. Tallon <br />questioned if the commission is creating something that will put the neighborhood in jeopaxdy. <br />Assistant Law Director Dubelko advised the provisions of the Subdivision Code limits the <br />commission from acting on a proposal based upon the compliance with the subdivision and <br />compliance with the zoning code provisions.
