? <br />?V <br />construction and these trees cannot be replaced. She asked if the City Forester, the residents, <br />and the project erigineer could work out a solution to protect these trees. Mr. Brennan stated the <br />commission will request that Mr. Wendell, the City Forester, evaluate the property. He <br />recommended that the residents attempt to set up a meeting with Mr. WendelL Mr. Grrindell <br />understood consideration of the trees and it is not his intentions to take down all the trees. He <br />suggested to Mr. Zwick that the property line be identified and properly marked so that the <br />residents are well aware where construction will take place. Mr. Brennan questioned if the <br />drainage meets engineering departments requirements. Assistant City Engineer McDermott <br />advised, although the engineering department has not done a tight check on it, the drainage does <br />appear adequate. He noted his department will check it tightly against calculations which will be <br />submitted. W. Brennan questioned if there will be any barrier installed to prevent the blowing of <br />debris onto the Peppermill Properties during the construction of Cinnamon Woods South. Mr. <br />Grindell recommended that an orange fencing be utilized to mark the line and catch any large <br />particles that may fall that d.irection. Mr. Morgan questioned how the three properties indicated <br />on the south west corner of Cinnamon Woods can be a part of the new development as he <br />believed that would require a transfer of real estate. Mr. Grindell advised Cinnamon Woods was <br />developed as a gradual condominnim and as each phase was built it was transferred from Hennie <br />Homes into the Association. He noted under Ohio Law you cannot even create a condominium <br />unless there is bu.ildings, as you cannot condominiumize raw dirt. Mr. Grindell continued, as a <br />certain number of buildings were built, they amended the condominium document to pick up the <br />next set of buildings and as they picked up build.ings they also picked up the common area that <br />goes with the buildings. He noted there are still some areas off of Lily Lane which have not <br />transferred because those units have not been completed and transfened. Mr. Grindell further <br />explained the south west wedge of Cinnamon Woods has not been transfened as that was going <br />to be transfened with the final part of Cinnamon Woods North. He stated all this information is <br />provided for in the Condominium declaration that is included in the county records. Mr. Morgan <br />wondered if construction of Cinnamon Woods South will perpetuate the amount of water ruu <br />off- Assistant City Engineer McDermott noted the system proposed, which is the forty eight <br />inch line ntnning the entire development, appears adequate and will probably even improve the <br />existing drainage. Mr. Morgan questioned the location of that drainage. Mr. McDermott <br />identified the point of outflow up through the six inch pipe into the ditch, and noted the <br />restriction of that pipe is causing the water to be held within the larger forty-eight inch pipes in <br />tanks. Mr. Stracken advised there was once a water problem on Peppermill Ct., and a french <br />drain was put in along the back of the property. He noted, although this took care of the water <br />problem, it took down all the roots from the trees behind his property. Mr. Stracken presented <br />pichues of before and after the french drain was constructed for the commission to review. Mr. <br />Grindell noted there was a drainage problem and possibly four trees and some brush were <br />removed to solve that problem He agreed to put some trees back if it is requested by the <br />association: Mr. Brennan clarified it should be put into the minutes that any trees that have been <br />damaged will be replaced. Mrs. Morgan asked if any trees will be removed on the south side of <br />the properry line and noted the residents were unaware of the property line location. She added <br />the residents on Peppermill Court paid a sizable premium because of the number of trees. Mr. <br />Grindell advised legally he cannot remove any trees from the north side of the property line, <br />however, they are permitted to remove trees on the south side of the property. He noted there is <br />at least a fifty foot rear setback. Mr. Grindell fiuther explained they will attempt to preserve as <br />ma.ny trees on the south side of the property line as possble, however there will be some trees <br />that have to be removed. to accommodate the drainage piping. Mr. Brennan stated this will be <br />refened to the City Forester, and Mr. Crrindell agreed to be receptive of any recommendations <br />6
