Mr. Grrindell, Mr. Puzzitiello, Mr. Elliot, and Mr. Zewick presented the proposaL Mr. Crrindell <br />identified the end of Cinnamon Way in xelation to the proposed development. It was reiterated both <br />parcels were recently annexed from Olmsted Township. In the township the zoning was R1-40 single <br />family, and this proposal is to rezone to Mixed Use to make the zoning classification consistent with the <br />existing Cinnamon Woods property. Mr. Grindell explained under 1149.03 C, the m'vxed use C <br />category allows for developments under 1135.01, sections A and B, which is the one and two family <br />code. He advised this project will be 86 units or 43 duplex homes. The developers objectives are to <br />quickly receive a favorable vote on: . the rezoning, assembly of the two parcels, and the preliminary land <br />use plan. Mr. Grindell explained originally the private road ran straight out to Cook Road, but it has <br />since been revised to reduce the amount of cut through traffic. The city will not be required to maintain <br />any of the streets for this development with the exception of the Service Road. Water Lines will run <br />through this property in accordance with city standards. All the storm water will be kept in <br />underground retention. C.E.I. has been contacted and there are adequate utilities for C.E.I. The <br />average price per unit is $165,000.00. The new development will have its own separate condominium <br />association from the existing Cinnamon Woods. The colors of the new development may change to <br />differentiate between the existing Cinnamon Woods and this new development. Mr. Manniug <br />questioned if the end of Cinnamon Way has been developed and was told there is a small street off of <br />Cinnamon Way called.Lily Lane, which has been developed. Assistant Law Director Dubelko advised <br />the former admivistration supported the annexation efforts of these two parcels, however, this is a <br />rezoning request and there are some important issues that planivng commission must address. In <br />addition, he explained the location, including the fact that this property is not on North Olmsted's <br />master plan, gives planning commission the opportunity to recommend the most appropriate zoning for <br />this land. Mr. Dubelko continued the present request to rezone to Mixed Use C would have to be <br />placed on the ballot and noted this zoning classification would allow retail and Multi Family. Mr. <br />('rrindell advised he was under the impression that Mixed Use C was covered under section 1135.01 A <br />and B of the zoning code, and he was willing to amend the application so as not to delay this process. <br />fIe explained the onlyreason they had.requested Mixed Use C is because that is the existing zoning for <br />the Cinnamon Waods development. Mr. Manning wondered why the access off of Cook Road was <br />needed. Mr. Grindell explained there are two reasons why both accesses are needed as this limits the <br />amount of traffic cutting through the existing Cinnamon Woods and there is also a safety concern with <br />limiting this to one access point. He noted one of the biggest concems from the current residents of <br />Cinnamon Woods was the proposed increase in traffic. Mr. Grindell requested the opportunity to <br />amend the application if rezoning to Mixed Use C would have to go on the ballot. Mr. Tallon <br />recommended rezoning to Single Family Cluster District, which is covered under section 1136. He <br />noted that would be the most appropriate zoning for this property. Mr. Grindell agreed to amend the <br />application to reflect the request is to rezone to Single Family Cluster District, in accordance with <br />chapter 1136 of the planning and zoning code. Mr. Tallon wondered if the building department had any <br />concems about this rezoning. Assistant Building Commissioner Rymarczyk advised he was not aware <br />of any problems concerning this type of zoning. Mr. Grindell agreed to amend the request and come <br />back in two weeks. Assistant Law Director Dubelko explained tabling tlie proposal may not be <br />necessary as plauning commission serves as a recommending body to council and can recommend that <br />this properiy be rezoned to Single Family Cluster I}istrict. He fiuther advised the proposal can then <br />move on to council and they will need a council member to sponsor an ordinance to rezone. Chairman <br />Tallon opened up the meeting for audience participation. Ward III Councilman Nashar, had several <br />questions including: is the cul-de-sac large enough to handle the fire equipment; will the treatment plant <br />be able to handle this new development; and would the developer consider blocking off this new <br />development from cuttiug through to Barton Road, as the Barton Road residents want to prevent any, <br />more increased traffic.
