<br />Mr. Conway stated that the code was changed in 1993 that required all drive-ways be of concrete or asphalt they <br />no longer permit any gravel drive-ways but, you have a non-confonning situation and anything new that gets put <br />in has to conform to the new code. Mr. McLoughlin stated that means if I do any work on my property I have to <br />put in a drive-way. Mr. Conway stated no but you are putting a garage up and it will need a drive-way to access <br />it and the code says that the drive-way has to be concrete or asphalt it no-longer pernuts gravel drive-way. Mr. <br />` Gomersall statetl why don't we make the variance good until May of 1999. All board members agree. <br />T. Kobema Moved to grant John MaLoughlin 4098 Clague Road; a variance to construct a detached garage, a 7 <br />ft. height variance; an 18 square foot variance in excess of the maximum area pernutterl; a variance to use second <br />floor of proposed garage for storage only, and a variance to use gravel drive for a period of one year. Violation of <br />ordinance 90-125 section(s) 1135.02 (C1 & D3), 1115.04 (D), and 1-161.11 (A). with the stipulation that Mr. <br />McLoughlin put in a suitable drive-way according to the building codes for the city of North Olmsted by May of <br />1999. The motion was seconded by R Gomersall and unanimously approved. Variance granted. <br />11. Janet M. McCrone 24358 Lebem Drive: <br />Request for variance (1123.12). Request special pernvt (1123.11) to enlarge a non-confornung building. Also <br />request the following variances to construct addition: an 11 foot variance for distance from existing detached <br />garage and a 21 foot rear setback variance. Violation of ordinance 90-125 section(s) 1165.02 (B) (1), 1135.02 <br />(C) (2), and 1135.08 (A). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to Janet McCrone. <br />Mr. Gomersall stated Ms. McCrone has an unusual situation here, in that you are -asldng to go within 4 ft. of the <br />garage, and that is close, if this board grants this proposal it will have to add to the motion that this garage will <br />have to have fire walls in it, you are suppose to be 15 ft. away from the garage. Ms. McCrone stated that the <br />inspector spoke to her about putting in fire walls. Mr. Conway stated that the board is requesting that walls and <br />ceiling be rated with-in the 15 ft. distance from the addition. Mr. Gomersall stated is there going to be =y <br />windows that face the garage. Ms. McCrone stated the new addition will be a walk-in closet. Mr. Gomersall <br />stated is your measurement from the over hang or the wall. Ms. McCrone stated the measurement is from the <br />wall. Mr. Gomersall statetl that the over hang would then be another 18" inches. Mr. Conway stated we can not <br />write in the fire wall the board will have to make that a stipulation of the variance, and it needs to be wall and <br />ceiling both. Mr. Gomersall stated that Ms.McCrone put fire walls in the application for the variance. D. <br />Conway stated even though Ms. McCrone wrote it in there is no code to cover this, you will have to make it a <br />stipulation to the variance. <br />J. Maloney moved to grant 7anet M. McCrone 24358 Lebern Drive,; a special pennit (1123.11) to enlarge a <br />non-conforming building. Also grant the following variances to construct addition: an 11 foot variance for <br />distance from existing detached garage and a 21 foot rear setback variance under the condition that a fire <br />separation wall is constructed per building department requirements. Violation of ordinance 90-125 section(s) <br />1165.02 (B) (1), 1135.02 (C) (2), and 1135.08 (A). The motion was seconded by J. Konold and Unanimously <br />approved Variance granted. . <br />12. Bemie Schmetzer: 23496 Mastic Road <br />Request special pernut (1123.11). Request a special pennit to use a tent for the purpose of <br />storage in a residential area while house is under construction. <br />Violation of ordinance 90-125 section(s) 1123.06 (A). <br />Chairman Gomersall called all interested parties before the board. The oath was administered to <br />Bemie Schmetzer Ms. Smith. Bemie Schmetzer presented the proposal. Ms. Smith present as interested party. <br />Mr. Gomersall stated you are asking for a special pennit to use a tent for the purpose of storage in a residential <br />area, and have the teazt up set 238 ft. back on your property now, the garage that is being tore down has nothing to <br />do with the request for the tent. Mr. Gomersall stated there is a time limit that needs to be placed on this, 1 year <br />should be si.fficient enough time.
