residential land rezoned to something else. He indicated that the board was probably tired of <br />seeing him before them addressing rezoning of residential land, but as long as he was in Council <br />he would continue to speak out against rezoning residential land. Mr. Turbrack, General <br />Manager for the North Olmsted Bus line commented that they support RTA's positiori and the <br />Cities position to rezone this site. There is currently a problem at the Great Northern parking lot <br />as there is an average of 120 cars parked in a 72-car parking lot. The overIlow has been going <br />into Chi Chi's and CompUSA parking lot. The number of riders continue to grow and a lot of the <br />riders are residents of North Olmsted, they are not all coming from Lorain County. The RTA <br />proposal to put in about 400 parking spaces, the City Bus line is very much in favor of. He feels <br />that RTA will meet the needs of the residents that are adjacent to the site. Ms. Feke indicated <br />earlier that the drawing that was shown tonight is a preliminary drawing. T.he proposed area is <br />the best location for the park and ride. The drawings are not final; if the ordinances are passed by <br />Council RTA will have to return before the Commission with a finalized drawing for approval. <br />VIr. Bohlmann reminded the Planning Commission that the issue before the board was ordinance <br />99-139 and 99-140 not the approval of the parlc and ride. Mr. Bohlmann indicated that if RTA <br />proceeds they will have to submit plans and go before the Planning Commission for approval. He <br />further questioned if he was correct in saying that when the RTA submits site plans to the <br />Planning Commission if they don't like it they have the right to turn it down. Mr. Tallon <br />responded ` that is correct". Mr. Brennan suggested tabling the ordinances, as there was not a <br />full quorum. Mr. Dubelko indicated that he would like to clarify the dialog that has been going <br />back and forth between the Chairman and the Service Director. If and when this property.would <br />be rezoned to the public facility overlay district, that would permit the uses in that Overlay <br />District. It is not accurate to say that if the Planning Commission doesn't like it they can turn it. <br />down. The Commission should understand that, if the rezoning occurs, then the proposed Park- <br />n-Ride facility will be a permitted use. If the Plannino, Commission determines the Facility <br />complies to the codes and it doesn't have those adverse effects that the zoning code talks about <br />then the Planning Corrunission would have to approve the-.proposal. Mr. Tallon questioned if the <br />audience understood what the Assistant Law Director was saying. A few residents from the <br />audience commented that they didn't understand what was said. Mr. Tallon asked Mr. Dubelko <br />to further explain what he was saying. Mr. Dubelko responded that he wanted everyone on the <br />Commission to understand that if the Planning Commission recommends the rezoning of this <br />property into the overlay district and Council approves, it is in fact rezoned. The park and ride <br />would then be a permitted use on that land and the City could not subsequently while it is zoned <br />in that classification turn down the proposal use. It can be turned down if it didn't meet the <br />requirements of that district and could also be turned down under chapter 1126 of the code which <br />has additional requirements over and above what each separate zoning district requires. It <br />requires Planning Commission to look at each specific proposal and determine if it adversely <br />impact upon residences and other properties in the areas of aesthetics and safety. The Planning <br />Commission's duty when a proposal comes through is, if the land is properly zoned, to look at the <br />proposal and if the Planning Commission finds that there is adverse impacts then the Planning <br />Commission is responsible to recommend changes to the plan to eliminate those impacts to the <br />extent practicable. If the Planning Commission finds that a proposal meets the basics of the code <br />and doesn't have the adverse impacts that are talked about in chapter 1126, then the Planning <br />Corrunission's responsibility is to recommend favorably to Council. Ms. Metter indicated that she <br />feels that this is a governmental method to do what they want to do with the property by this <br />10
