Overlay districts are relatively new zoning concepts, which he <br />discussed with the Planning Commission, when the telecommunications overlay district was added <br />last year. It superimposes another layer of zoning on top of the existing zoning. This would <br />enable the landowner to continue to use the land for single family purposes if the owner desires, <br />but would also allow it to be used for other uses, which are permitted in the overlay district. In <br />this instance, the subject property would be permitted to be used for parking for an RTA facility. <br />There may be several other governmental type uses that would be permitted in the overlay district. <br />The Overlay District will allow RTA to construct a park and ride on the subject property. If for <br />some reason in the future RTA no longer wants to operate the facility, or if the owner of the <br />property is someone other than RTA and does not want to use the land for a parking facility or <br />other permitted governmental use, then the only permitted use would be single family residential. <br />That is essentially what 99-139 does in respect to creating the district, providing for the uses <br />permitted and the restrictions on those uses as described. 99-140 is the actual rezoning <br />ordinance, which takes the effected parcels of land and rezones them into that overlay district. <br />Mr. Brennan questioned if the City was in a rush with respect to ordinance 99-140 to designate <br />this area as the ultimate park and ride facility area in the City of North Olmsted. In reading some <br />of the Council minutes he thought there was going to be some discussions and searches made to <br />find the best location for the park and ride. He questioned if the City was rushing into ordinance <br />99-140 before the homework has been done and other areas looked into to make sure it is placed <br />in the proper location. Mr. Dubelko indicated that he was not prepared to answer that question, <br />as he had not been involved with any of the RTA negotiations. The only knowledge on the matter <br />he can bring to the table essentially is what ordinance 99-139 provides and what 99-140 provides. <br />If the Plaiuung Commission feels that they are being rushed into making a recommendation on this <br />then they can as with all other zoning ordinances request additional time from Council to consider <br />the matter. Mr. Brennan remarked that Ordinance 99-140 created a nuisance for the residents <br />that live on Kennedy Ridge Rd so why should it be rushed into. There should be committee <br />searches made before going ahead and approving the ordinance that will designate those parcels <br />as the park and ride. Mr. Dubelko indicated that the Director of Public Service was present and <br />he may be able to answer Mr. Brennan's questions. Mr. Bohlmann indicated that as a part of the <br />administration and part of the group of people that looked at all the available sites, which were <br />about 3 or 4 possible sites. They felt that as an Administration the best possible location for the <br />park and ride is what is presently being proposed to the board tonight. Mr. Brennan questioned <br />what the criteria was for the park and ride. Mr. Bohlmann indicated that location was the major <br />criteria. Mr. Brennan suggested that he viewed a.park and ride with respect to Strongsville's <br />Park and Ride it is surrounded by bike trails and the turnpike. RTA wants the park and ride near <br />the freeway, but here it will abut residents. The park and ride would not be serving North <br />Olmsted as North Olmsted has their own buses. The people that the park and ride will serve will <br />be from other communities. Mr. Bohlmann indicated that North Olmsted currently had a park and <br />ride located at Chi Chi's restaurant, which is over filed. He disagreed with Mr. Brennan as both <br />residents and non-residents currently use the park and ride at Chi Chi's. There was a research <br />done on where the riders live and it was found that about 60% if the people using the Chi Chi's <br />park and ride location were North Olmsted residents. Mr, Brennan suggested that there was a <br />line of cars every morning on 252 waiting to get onto 1480. Mr. Bohlmann reviewed that there <br />was a license plate study and mentioned some of the names of towns that use the current park and <br />ride. He would never try to lead the board to believe that only North Olmsted residents would <br />7
