<br />commented to the Commission that the issuance by the L,andmark Commission of a certificate <br />of appropriateness, and the plans' approval process by the Landmarks Commission, are in the <br />nature of recommendations by the Commission to Council which must ultimately approve or <br />disapprove the project. In this connection, it is his opinion that the Board of Zoning Appeals <br />retains its jurisdiction to grant or deny variances which may be recommended by the <br />Landmarks Commission, because the Board of Zoning Appeals is the only city body, by virtue <br />o£ the City Charter, which can grant variances from the Zoning Code requirements. The <br />Landmarks Commission recommendations concerning historic preservation should carry <br />heavy weight as a proposal moves through the City approval process, but all boards retain <br />their jurisdiction to act in accordance with their Charter or ordinance authority. As in any <br />other proposed development, such development proposals ultimately go before Council for <br />Council's ultimate determination of whether or not the development should be approved. Mr. <br />Conway indicated that there were setback issues for building, parking and signage. Mr. <br />Conway commented that he would have a list for the Planning Commission when CVS <br />returned to the next meeting. Mr. Zimmerman reviewed that parking and building setback <br />issues were addressed with the Landmarks Commission as CVS would have had to purchase a <br />residential lot and request that it be rezoned to meet the zoning code requirements. Mr. <br />Tallon questioned the wall along the south rear end of the lot. W. Wojtila indicated that <br />there would be a 3-foot high brick wall that will match the brick of the building. Mr. Tallon <br />inquired the measurement of the landscaping area along the wall. W. VVojtila remarked that it <br />would be a 5-foot landscaping strip. W. Koeth asked to see the picture, which showed the <br />side of the building that would face Lorain Road and questioned if there would be any trees to <br />buffer the size of the wall. Mr. Zimmerman showed a layout with the fence and trees that <br />would be put in front of the building. Mr. Koeth commented that the board would like the <br />traffic traveling _east to have a better view. W. Tallon questioned the elevation of the front <br />wall. Mr. Zimmerman indicated that the height of the wall was 22 feet high. W. Koeth <br />questioned what the color of the brick would be. Mr. Wojtila indicated that the color would <br />be a Mohican blend. Mr. Tallon questioned if the back part of the building would be the <br />storage area. Mr. Zimmerman reviewed that the height of the building was lowered and the <br />back end was bubbled out to eliminate the need for a mezzanine. Mr. Tallon questioned the <br />square footage of the building. W. Wojtila reviewed that the square footage would be larger <br />but the building itself has been lowered. W. Koeth questioned what the hours of operation <br />would be. Mr. Wojtila commented that he believed they would have typical business hours <br />from 9:00am to 10;00pm. Mr. Tallon questioned if the drive-through exit would be a safety <br />issue as it was so close to the corner. 1VIr. Conway commented that there was nothing to <br />address the drive-through in the zoning code. He suggested getting a report from the <br />Engineering Department. W. Gareau suggested that the developer uiformed the Landmarks <br />Commission that they would average about 2 cars an hour. Mr. Tallon suggested placing a <br />speed bump at the sidewalk. Mr. Self indicated that there would not be a lot of traffic as the <br />drive-through would basically be used for prescriptions and make the building ADA <br />compliant. The drive through is basically for handi cap and elderly. W. Hreha questioned if <br />the ground sign would be replaeed. N1r. Self suggested that there would be a ground sign but <br />they would be working more with the Landmarks Commission and residents to see what <br />would be acceptable. Mr. Tallon suggested that the delivery area should be such that a truck <br />would back up straight instead of at an angle. Mr. Wojtila indicated that that could be done. <br />W.
