.? <br />have arisen. The applicant can not get an 18 foot wide driveway between the 2 parking areas <br />as the plans show just under 13 feet and code requires 18 feet. He is not sure if it was cased <br />by the building but there is only a little over 4 feet grass area between the end of the parking <br />and the property line were landscaping should be 10 feet from the parking are. 1VIs_ Kopko <br />remarked that the owner was given a variance to be 5 feet from the property line and asked if <br />the drawing showed 4 feet. Mr. Conway indicated that the current plans showed 4.33 feet <br />and the variance was for the far side. 1VIs. Kopko suggested that the variance was granted for <br />the side in wluch the landbanked parking was placed. Mr. Conway commented that then the <br />width of the drivevvay would need to be addressed. Mr. Tallon remarlced tliat he was not sure <br />of the exact variances allowed, but would like the issue checked into. He questioned what <br />would be located in the building. Ms. Kopko indicated that J.C. Hair design salon would <br />occupy one area and the other area will be a business use. Mr. Tallon questioned if the new <br />structures required the additional parking. Mr. Conway suggested that he didn't think the <br />additional parking was required, but Mr. Christou is requesting to use the landbanked parking <br />now. 1VIr. Tallon remarked that then the use of the landbanked area is not needed. Mr. <br />Conway indicated that the applicant had sufficient parking without using the landbanked <br />parking. Ms. Kopko indicated that the requirements of the building were close. She further <br />commented that the applicant was granted a variance to have fewer parking spaces then what <br />they were required to have, before the landbanked area was designated. Mr. Tallon suggested <br />there had been a variance granted for the West Side only. Mr. Conway clarified that 2 parking <br />spaces are required for the house and 10 parking spaces for the addition, therefore 12 parking <br />spaces were required and that is why the landbanked area was designated. Mr. Tallon <br />indicated that he wanted to find out exactly what variances were granted before proceeding. <br />1VIrs. O'Rourke commented that the reason the landbanked area was put were it was, was <br />because the daycare walked the children along that area. 1VIr. Tallon questioned if the current <br />drawings were accurate. Ms. Kopko indicated that she believed the plans were accurate. NIr. <br />Conway suggested that it sounded like the applicant took the curbing into the 5-foot area. He <br />questioned if the curbing had been put in place. . Ms. Kopko commented "no". Mr. Tallon <br />questioned if there was anyone from the audience that had questions pertaining to the <br />proposal. No comments were made from the audience. <br />R. Tallon motioned to table J.C. Hair Design of 28813 Lorain Road which consists of land <br />banked parking until the October 26, 1999 Planrung Commission meeting. The board wants <br />an accurate drawing and a list of the variances that were granted for this property. Iv1s. <br />Kopko questioned if they could address the boards issues with the Board of Zorung Appeals <br />board instead of returning to the Planning Commission meeting. Mr. Tallon remarked that the <br />applicant would return with the required documents October 26, 1999 and then this board will <br />give their recommendations to the Board of Zoning Appeals at that point. At this point Mr. <br />Christou indicated that he needed to speak. IIe commented that if the surveyor would have <br />done his job right they would not be where they are now. He has deadlines that they have to <br />meet, the building has started. The rrustakes of the surveyor are costing him now. Mr. <br />Christou indicated that Mr. Tallon suggested the landbanked parlcing and brought a lie to him <br />when he talked about being able to use it later if needed. If he were to do the parking later it <br />would cost more money to bring the workers back out. So he asked Ms. Kopko if the <br />landbanked parking could be used now and she told him yes. We have already apologized for <br />the mistakes that were made. Mr. Christou remarked that he thought he had the right to make <br />9
