establish a cluster community. Mr. Tallon indicated that in the original development he believed <br />the golf course was to remain in tact as a golf course or it would revert back to the City. Mr. <br />Conway indicated that he didn't know about reverting back to the City. Mr. Tallon suggested <br />the owners had to maintain it as a golf course. Mr. Conway commented that was how the <br />proposal was made. W. Tallon commented that there was 5 acres of land classified as A <br />residential with a density of 3 homes per acre, which would give you 15 homes minus some land <br />that would have to be used for roads and improvements. So that would mean you could build <br />10 to 12 class A homes in that area. He then questioned why other than numbers would the <br />developer what to rezone the area. Mr. Bower indicated that it was strictly for the numbers. <br />Mr. Tallon suggested a road would have to be placed through the golf course, which goes <br />against the grain. Mr. Bower indicated that there was currently a road that crossed the golf <br />course now. Mr. Tallon suggested part of the land, which is currently golf course, would be <br />changed into a road. That alone changes the complexion of what the original intent to build <br />ViewPoint. Mr. Bower suggested the area is residual property. Mr. Tallon indicated that when <br />the City agreed to viewpoint the golf course was to remain in tact, now you are changing <br />midstream. Mr. Bower indicated that in 1993 he lived in his home and didn't plan on moving <br />but if he would have made it part of the plans then there would be no difference in where the <br />road was placed. Mr. Tallon commented that he was not sure about that and that was past <br />tense. To take property that is zoned residential and can be used to build class A residential <br />homes and then request to build a home on a non-conforming lot doesn't make sense. The <br />board is not saying you can't develop your land, you can build 10 to 12 residential homes and <br />sale them for 200,000 dollars a piece or more, which can be nice. Mr. Bower indicated that <br />cluster homes sold for 200,000 dollars a piece. The whole golf course was classified as A <br />residential before it was rezoned cluster and the Cities appearance would not be as good as it <br />presently is today. W. Tallon disagreed and suggested that if Mr. Bower built them nice it <br />would have been a nice community. Mr. Spalding questioned if the current cluster homes were <br />a cul-de-sac. Mr. Bower indicated he was correct. Mr. Spalding questioned if the original plans <br />showed Greenway as a cul-de-sac. Mr. Bower again indicated he was correct. Mr. Spalding <br />indicated that now the developer is changing it into a street. Mr. Bower commented that there <br />would be a street off of the cul-de-sac. Mr. Spalding indicated that then there would no long be <br />a cul-de-sac. Cluster home #1 on the plans would be built in the existing cluster area as well as <br />cluster home # 2. Mr. Bower indicated that they would just be replacing duplex lots. Mr. <br />Spalding questioned cluster 93. Mr. Bower indicated that cluster #3 would be an addition. Mr. <br />Spalding questioned if #3 were part of the original plans of the clusters as well as to expand <br />beyond that. Mr. Bower commented "no", that would be on part of the residue golf course <br />property. Mr. Spalding commented that cluster #3 would be on part of the golf course as <br />indicated on the current plans. Mr. Bower indicated "yes". Mr. Spalding commented then that <br />is were the additions would start. Mr. Hreha indicated that the entire time the existing <br />development was taking place the developers didn't build on the area of the proposed cluster #1 <br />and 2 as it was left open. Mr. Bower indicated that he believed that everyone in the cul-de-sac <br />knew that the area was for future development. A number of audience members commented <br />that, that was not true. Mr. Hreha commented, then you left that area open intentionally. <br />Presently on the current plans there is nothing between cluster # 13, and 14. He indicated that <br />the owner has commented that they have no intentions of cutting into Louis Road, so why then <br />isn't he building more clusters between cluster # 13 and 14. Mr. Bower suggested that area is <br />12
