Mrs. Ausse indicated that the noise from the <br />pool emanates into their family room, as well as it being so close to their home. To watch TV the <br />windows and doors have to be closed. Mr. Ausse indicated that there were three houses that surrounded <br />their lot that all had pools. He feels that if the pool and deck were allowed he would have to put up a <br />fence to block the view. He suggested he didn't have a problem with the pool he just doesn't want to have <br />to look at it when he looks out his window. Mrs. Ausse suggested that anyone standing on the deck could <br />look right into her home. If the applicant put up a 6-foot fence it would bufFer the noise and shield the <br />view. 1VIr. Gareau questioned if the deck was already built. Mrs. Ausse indicated that the deck was not <br />yet built. . Mr. Ausse commented that the pool in the rear of the yard was not a problem, and the <br />applicants were good neighbors, he is just concerned that the pool is closer to his house than the <br />applicants. I3e understands that there will be noise, but feels there should be a fence put up and doesn't <br />feel he should have to be the one to put it up. Mr. Gareau questioned if the applicant would be willing to <br />put up a fence in return for a variance if that were the case. Mr. Montalvo suggested that the height of the <br />deck would invade on the privacy of the homes, and fmds it a bit uncomfortable. He would also like to see <br />the fence high on his side of the lot also. Mr. Nashar suggested that the fence being put up would help and <br />asked if the applicant would be willing to put up a fence as a compromise. Mr. & Mrs. Ausse again <br />indicated that they were concern about their viewing the deck from their windows. Mr. Gareau suggested <br />there were two choices, if the height of the deck is the cause of the concern, and it is going to create a <br />problem then you don't grant the variance for the deck and the problem is solved. If you want to put the <br />deck in were there is a problem created, you put up a fence to ameliorate that.problem, and possibly make <br />everyone happy. Mr. Busse indicated that he didn't have a problem putting up a fence if that would help, <br />but he didn't feel that he should have to pay for the entire fence. IVIr. Conway questioned if the fence <br />would be on the property line. Mr. Busse questioned if the property line should be moved back 1 foot like <br />it is supposed to be or just leave it were it is now. He indicated that the deck would be aesthetically <br />pleasing. Mr. Gareau suggesting that a 6-foot fence is pernlitted and asked how high the deck would be. <br />Mr. Busse indicated that it would be 4 feet high and with him standing on the deck he would be looking <br />over the fence. Mr. Gareau indicated that as a condition to building the deck for the lot coverage the <br />board can require that a 6-foot fence be constructed. He questioned if the board would require the fence to <br />be around the entire backyard, or what sides. Mr. Maloney indicated that it would only be across the back <br />property line. Mr. Konold questioned how wide the back property line measured. Mr. Maloney suggested <br />it was about 70 feet wide. Mr. Conway indicated that hE would need to know when the fence would be <br />put in place, as the pool. is in place, and the deck is ready to go. Mr. Conway commented that the deck <br />and fence wouldn't be put up at the same time and asked Mr. Busse when he thought he could have the <br />deck up by. Mr. Busse commented that he wouldn't be allowed to pick up his pernut until Wednesday, <br />but if he could have it before the weekend he might be able to have the fence up before the weekend is out. <br />Mr. Conway questioned if the applicant had already started the deck. Mr. Busse indicated that he had <br />started the deck as he thought the permit for the pool would cover the deck. Mr. Conway questioned if - <br />there were construction drawings submitted to his department. Mr. Busse commented that he had <br />submitted construction drawings the day after the stop order was submitted. Mr. Conway suggested that <br />Mr. Busse contact the inspector in the morning and maybe the Building Department would be able to help <br />him push the proposal along. Mr. Busse agreed to call the inspector and indicated that as soon as the deck <br />was up he would start work on putting up the fence. Mr. Montalvo questioned if the applicant would be <br />replacing the fence on his side of the yard. Mr. Busse suggested that he felt it wasn't needed as there was <br />currently 6 foot bushes and landscaping which blocked Mr. Montalvo's home, so he didn't feel it was <br />warranted. Mr. Montalvo indicated that he had came before the board in the past and he was told he had <br />to cut his fence down to a 4-foot height. He asked if he could now put up a 6ft fence in his yard. Mr. <br />Conway indicated that Mr. Montalvo could put up a 6-foot fence in his rear yard, but if it were a corner <br />lot it would be relative to how it relates to his neighbors. Without seeing a site plane he could not just give <br />Mr. Montalvo a blank answer. No further comments were made. <br />8
