W. Kremzar motioned to approve Joseph Repic of 23365 Marion Road his request for variance <br />(1123.12). Which consists of a new garage and that the following variance be granted: <br />1) A 2 foot 6 inch variance for sideyard setback, (code requires Sft, applicant shows 2ft 6in). <br />Which is in violation of Ord. 90-125 section, (1135.07 A). The motion was seconded by T. Kobema and <br />unanimously approved. Variance Granted ' <br />3. Kurt Dunlap• 29275 Hastings Drive: <br />Request for variance (1123.12). The proposal consists of a fence. <br />The following variance is requested: <br />An 18-inch height variance needed for fence, 14feet long in a front building setback, (code limits the height <br />to 30", and applicant shows 48"). <br />Which is in violation of Ord. 90-125 section, (1135.02 F 1). <br />Chairman Gomersall called all interested parties forward, and reviewed the variance requested. Mr. <br />Dunlap came forward to review his request. Mr. Gomersall questioned why a building permit was not <br />applied for and a 30-inch fence was not constnzcted. Mr. Dunlap indicated that he needed the fence for <br />landscaping purposes as well as privacy for his family, and that he was not aware that a building permit <br />was required for landscape structures. Mr. Gomersall indicated that there were two big fur trees that <br />existed and didn't feel that high of a fence was required. He suggested a 30-inch high fence would be <br />adequate. Mr. Maloney indicated tha.t he felt the height of the fence could be lower also as the height of the <br />trees provide privacy. Mr. Dunlap indicated that he planed on digging up the left side of his garage and <br />add a concrete slab to park his truck. He didn't want his truck being parked on the _side of the garage to <br />become an eye sore to the development. He suggested that the dirt taken from the lift side of the garage <br />would be used in front of the fence to develop a landscaped mound and the existing trees would be <br />relocated. Mr. Gomersall commented that Mr. Dunlap being a developer should have known he needed a <br />building pernut to install a fence, but chose to install the fence anyway. Mr. Dunlap suggested he wAs not <br />aware that he needed a permit to install a landscape fence, and didn't know there was a 30-inch height <br />limit. Mr. Kobema indicated that he didn't have a problem with the request and felt that if the neighbors <br />did they would have been present to voice their concerns. Mr. Konold commented that he didn't have a <br />problem with the request but felt that as Mr. Dunlap is a developer and he should have lnown to check <br />with the building department and the code before doing the work. Mr. Kremzar inquired as to when Mr. <br />Dunlap found out he needed a. pernut for the fence. Mr. Dunlap indicated that he was made aware of <br />needing a permit when a building inspector stopped by his home and made him aware that he needed a <br />permit to install a fence whether it was for landscaping or not. No further comments were made. <br />J. Proposal consists of temporary signage. <br />'ne following variance is requested: <br />A temporary sign variance for tlie following dates: September 20 through 25, 1999, and December 13 <br />through 18, 1999. Said signage to be a 4'x 8' foot mobile sign unit. <br />Which is in violation of Ord. 90-125 section, (1163.12 G). <br />Chairman Gomersall called all interested parties fonvard, and reviewed the variance requested. Ms. <br />Costello, The owner of Hobby's Etc. Came forward to review her request. Mr. Gomersall commented that <br />the variance would cover 5 days for each event.
