Mr. & <br />Ms. Brown, the owner of the property, Tyline their daughter, Mr. Round, with American patios and Mr. <br />Schawab, a concerned neighbor came forward to review the proposal. Mr. Gomersall questioned if the <br />neighbor understood the proposal. He asked Mr. Brown to review what he would like to do. Mr. Brown <br />indicated that he just wanted to enclose the e,cisting patio. Mr. Schawab suggested the lot was small and <br />he would like to know about the variances as he abuts the Brown's property. Mr. Gomersall reviewed that <br />Mr. Brown was required to be 50 feet back from his rear properiy line and he is asking to be 33 feet <br />therefore they need a 17 foot variance. 1VIr. Gomersall indicated that he didn't feel that the enclosure would <br />hinder the property. All the board members agreed that enclosing the patio would only enhance the <br />property value of the home. No further comments were made. <br />J. IVialoney motioned to approve Calvin & Lillie Brown of 24429 Woodside Drive their request for <br />variance (1123.12). Which consists of adding a patio room to the existing home and that the following <br />requests be granted: <br />1) A special permit to add to a non-confornung building, (1165.02). <br />2) A variance to enlarge a non-conforming dwelling, (1165.02). <br />3) A 17foot rear yard variance, (code requires SOft, applicant shows 33ft), (1135.08 A). <br />Which is in violation of Ord. 90-125 section, (1135.08 A) and (1165.02). The motion was seconded by T. <br />Koberna and unanimously approved. Special Permit and Variances Granted <br />11. Francis McCafferty• 4029 Canterburv Road: <br />Request for variarice (1123.12). The proposal consists of an addition to the existing home. <br />The following variance is requested: <br />A 9foot variance for rear yard setback, (code requires 50ft, applicant shows 41ft). <br />Which is in violation of Ord. 90-125 section, (1135.08 A). <br />Chairman Gomersall called all interested parties forward, and reviewed the variances requested. Mr. <br />McCafferty came forward to review his requests. Mr. Gomersall reviewed that a neighbor Rosemary <br />Yehlik contacted the clerk and indicated that she didn't have any objections to the request. He further <br />commented that the board had no objections to the request. No further comments were made. <br />J. Konold motioned to approve Francis McCafferty of 4029 Canterbury Road his request for variance <br />(1123.12). Which consists of an addition to the existing home and that the following variance be <br />granted: A 9 foot variance for rear yard setback, (code requires SOft, applicant shows 41ft). <br />Which is in violation of Ord. 90-125 section, (1135.08 A). 'I'he motion was seconded by W. Kremzar and <br />unanimously approved. Variance Granted <br />12. West Marine: 24781 Lorain Road: <br />Request for variance (1123.12). The proposal consists of a sign package. <br />The following variance is requested: <br />1) A variance to alter a non-confornung pole sign. <br />Which is in violation of Ord. 90-125 section, 1163.19. <br />NOTE: Code states "That no legal non-conforming sign or part thereof shall be altered, modified, changed <br />or changed in use in any manor what so ever in any process of reconstruction, repair, maintenance or <br />restoration of all or a part thereof unless the entire sign shall be brought into compliance with all of the <br />provisions ofthis Zoning Code", (1163.22 Prohibits pole signs). <br />7
