<br /> <br />J. Maloney inotioned to approve James Blake of 23916 Elm Road his request for variance (1123.12). Which <br />consists of a swimming pool and that the following variances be granted: <br />1) A variance to install a swiinming pool less than the required front building setback for the abutting lot on the <br />side street. (1135.02 D 5) <br />2) A 1.5 square foot variance for total area of rear yard accessory structure (code allows 852.5sq ft, applicant <br />shows 854sq ft) (1135.02 D 2). Which is in violation of Ord. 90-125 sections, (1135.02 D 2& 5). The motion <br />was seconded by W. Kremzar and unanimously approved. Variances Granted. <br />11. North Olmsted Assemblv of God Church: 3874 Columbia Road: <br />Request for variance (1123.12). Proposal consists of expanding eYisting gravel parking area. <br />The following variances are required: <br />1) A variance not to install a concrete or bituminous concrete pavement parking lot or provide drainage or <br />curbing for the same as required by the zoning code, (1161.11). <br />2) A 15 foot variance for sideyard setback (code requires 20ft setback; applicant shows Sft) (1118.02 (2 C). <br />3) A 15 foot variance for rear yard setback (code requires ZOft setback, applicant shows 5ft) (1118.02 (2 C). <br />Which is in violation of Ord. 90-125 sections, (1161.11) and (1118.02 (2 C). <br />Chairman Gomersall called all interested parties forward and reviewed the variances being requestecl. Mr. Bill <br />1Vlace, a representative from the Church, came fonvard to present the proposal. 1VIr. Gomersall asked <br />Rymarczyk about the issue of water problems. Mr. Rymarczyk indicated that the engineerulg department is <br />requesting a retention basin, lighting and some improvements to the parking lot before the permit is granted. He <br />indicated that he had spoken to the City Engineer, P. Deichmann who indicated that a letter was sent to the <br />applicant informing him of the engineering requirements. Mr. Mace indicated that the church understood what <br />was need. He further commented that the Church was presently in the process of purchasing neighbors property. <br />The Church would like to add an addition in two years and did not Irnow a pernut was needed to put the gravel <br />driveway in place. Mr. Koberna informed Mr. Mace that the gravel could not be finished until the .drainage <br />issue was resolved. Mr. Gomersall indicated he received a letter from the City Engineer, Mr. Deichmann and it <br />inclicates, section 927.06 of the codified ordinances does require storm water retention for gravel parking areas <br />or dnveways. Plans must be submitted to the Engineering Department for both the parking lot and retention <br />plans and a professional Engineer must prepare calculations. Mr. Gomersall asked if Mr. Mace received the <br />letter. Mr. Mace indicated he had only received a copy of the notice and agenda for tonights meeting. Mr. <br />Gomersall indicated that even if the variances were granted to night the Church could not continue the work until <br />the Engineering requirements were met. Mrs. Mary Beth Sedgrner, a concerned neighbor came forward and was <br />sworn in. She indicated that she was not sure what was being done. The traffic is very heavy corriing and going <br />from the church. There has been a problem with traffic coming from the church, the drivers don't use their <br />blinkers or stop to see if there are on coming cars. There is a blind turn right past the church, the additional <br />parking will increase the traffic. She is concerned that there is too much traffic now and allowing the additional - <br />parking lot would add to the existing problem. Mr. Koberna indicated that the Church is purchasing additional <br />property and the cars are presently parking on the lawn now. Mrs. Sedgmer indicated that there is always <br />traffic coming and going from the church because of the daycare. Mr. Koberna indicated that the only issues <br />that the board could address is the gravel parking area. Mrs. Sedgmer indicated that if the church eYpands that <br />would only increase the traffic. Mr. Gareau indicated that a Church located in residents district has to have a <br />special permit for any expansion they wish to do. As far as a special permit there is about 9 items that the <br />Planning Commission has to review. A few of the issues that you mentioned you are concerned with are issues <br />that the Plaiuung Commissioners review. When the church comes before the Planning Commission for their <br />addition, you will again receive a notice and that would be the appropriate time to raise your concems of the <br />traffic issue and how it will effect the surrounding properties. Mrs. Sedgmer indicated that because it is a <br />daycare as well as the Sunday services the traffic is bad,, she has had cars in her yard because of accidents. She <br />has had to call the police because of the reckless driving. Mr. Gareau indicated that if the Church plans on <br />elpanding they will go before the Plaiuung Commission and that will be the board that could address that issue. <br />The Board of Zoning Appeals can not address traffic issues. Mrs. Sedgmer asked Mr. Mace if there was <br />5
